Letter to Diane Feinstein

Senator Feinstein,

My local news broadcast made mention of the fact that President Bush is going to meet with members of the Senate to try and revive S. 1348. It appears that the President is going to try and persuade, (bully) some Republican Senators into changing their votes to allow this bill to pass cloture and go on to a final vote.

I am past anger at the arrogance of the President and those members of the United States Senate, who behind closed doors came up with this travesty of a bill that the Senate tried to force feed the American people, saying it would solve all our immigration problems.

If I recall correctly, we were fed the same lies back in 1986. How goes the old saying, "fool me once, shame on you, fool me twice...". I am not fooled by the Kyl/Kennedy bill. Since I have been unable to successfully contact your office by phone, I imagine that many of your constituents are not fooled as well.

We, the people of these United States are tired of our voices being ignored and disregarded by our elected representatives. By virtue of the fact that we voted for you, (although sometimes I wonder why), you are obliged to listen to us, or have your forgotten that fact? The majority of the legal citizens in this country do not want any new immigration laws passed. We are tired of laws being written, then not enforced.

Groups such as the Coalition for Comprehensive Immigration Reform have more say in the U.S. Senate than the American People and we are not going to sit back and remain silent any longer.

You took an oath of office which states, “I do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter”.

Article VI of the Constitution, which you swore to uphold states, “This Constitution, and the laws of the United States which shall be made in pursuance thereof;...shall be the supreme law of the land.”

With that being said, allow me to make a suggestion. I would recommend that you forget about trying to revive S. 1348 and try a unique concept, enforce our existing immigration laws. We have all the laws and guest worker programs we need to solve our problem with illegal immigration, IF THEY WOULD JUST BE ENFORCED!

S. 1348 would grant a special Z visa to almost every single illegal alien in this country. Even gang members would only have to renounce their gang membership to obtain this visa. How ludicrous! Of course they would renounce it for legalization, but would they mean it?

According to Title 8 U.S. Code Section 1182, Inadmissible Aliens:

(a) Classes of aliens ineligible for visas or admission
Except as otherwise provided in this chapter, aliens who are
inadmissible under the following paragraphs are ineligible to
receive visas and ineligible to be admitted to the United States:

(2) Criminal and related grounds
(A) Conviction of certain crimes
(i) In general
Except as provided in clause (ii), any alien convicted of,
or who admits having committed, or who admits committing acts
which constitute the essential elements of -
(I) a crime involving moral turpitude (other than a
purely political offense) or an attempt or conspiracy to
commit such a crime, or
(II) a violation of (or a conspiracy or attempt to violate) any
law or regulation of a State, the United States, or a foreign
country relating to a controlled
substance (as defined in section 802 of title 21), is
inadmissible.

According to that title of the U.S. Code, any illegal alien is inadmissible to the United States due to the fact that they have entered this country illegally, or overstayed their visa. They are not entitled to stay! You are sworn to uphold this law. Shall I continue?

I tried to read through the text of S. 1348 as best I could and I could not find any mention of physical screening of the estimated 12-20 million illegal aliens prior to their receiving this Z visa.

According to 8 U.S. Code Section 1222, Detention of aliens for physical and mental examination:

(a) Detention of aliens
For the purpose of determining whether aliens (including alien
crewmen) arriving at ports of the United States belong to any of
the classes inadmissible under this chapter, by reason of being
afflicted with any of the diseases or mental or physical defects or
disabilities set forth in section 1182(a) of this title, or
whenever the Attorney General has received information showing that
any aliens are coming from a country or have embarked at a place
where any of such diseases are prevalent or epidemic, such aliens
shall be detained by the Attorney General for a sufficient time to
enable the immigration officers and medical officers to subject
such aliens to observation and an examination sufficient to
determine whether or not they belong to inadmissible classes.

The aforementioned Section 1182(a) states:

(a) Classes of aliens ineligible for visas or admission
Except as otherwise provided in this chapter, aliens who are
inadmissible under the following paragraphs are ineligible to
receive visas and ineligible to be admitted to the United States:

(1) Health-related grounds
(A) In general
Any alien -
(i) who is determined (in accordance with regulations
prescribed by the Secretary of Health and Human Services) to
have a communicable disease of public health significance,
which shall include infection with the etiologic agent for
acquired immune deficiency syndrome,
(ii) except as provided in subparagraph (C), who seeks
admission as an immigrant, or who seeks adjustment of status
to the status of an alien lawfully admitted for permanent
residence, and who has failed to present documentation of
having received vaccination against vaccine-preventable
diseases, which shall include at least the following
diseases: mumps, measles, rubella, polio, tetanus and
diphtheria toxoids, pertussis, influenza type B and hepatitis
B, and any other vaccinations against vaccine-preventable
diseases recommended by the Advisory Committee for
Immunization Practices,
(iii) who is determined (in accordance with regulations
prescribed by the Secretary of Health and Human Services in
consultation with the Attorney General) -
(I) to have a physical or mental disorder and behavior
associated with the disorder that may pose, or has posed, a
threat to the property, safety, or welfare of the alien or
others, or
(II) to have had a physical or mental disorder and a
history of behavior associated with the disorder, which
behavior has posed a threat to the property, safety, or
welfare of the alien or others and which behavior is likely
to recur or to lead to other harmful behavior, or
(iv) who is determined (in accordance with regulations
prescribed by the Secretary of Health and Human Services) to
be a drug abuser or addict,
is inadmissible.

Next I would like to mention 8 U.S. Code, Section 1324 in regards to those who have provided sanctuary for illegal aliens, to include they mayors of every city who has passed ordinances stating that their cities are sanctuary cities, and the churches that provide sanctuary for known illegal aliens. They should be tried and convicted for violation of U.S. law.

Sec. 1324. Bringing in and harboring certain aliens

(a) Criminal penalties
(1)(A) Any person who -
(i) knowing that a person is an alien, brings to or attempts to
bring to the United States in any manner whatsoever such person
at a place other than a designated port of entry or place other
than as designated by the Commissioner, regardless of whether
such alien has received prior official authorization to come to,
enter, or reside in the United States and regardless of any
future official action which may be taken with respect to such
alien;
(ii) knowing or in reckless disregard of the fact that an alien
has come to, entered, or remains in the United States in
violation of law, transports, or moves or attempts to transport
or move such alien within the United States by means of
transportation or otherwise, in furtherance of such violation of
law;
(iii) knowing or in reckless disregard of the fact that an
alien has come to, entered, or remains in the United States in
violation of law, conceals, harbors, or shields from detection,
or attempts to conceal, harbor, or shield from detection, such
alien in any place, including any building or any means of
transportation;
(iv) encourages or induces an alien to come to, enter, or
reside in the United States, knowing or in reckless disregard of
the fact that such coming to, entry, or residence is or will be
in violation of law; or
(v)(I) engages in any conspiracy to commit any of the preceding
acts, or
(II) aids or abets the commission of any of the preceding acts,
shall be punished as provided in subparagraph (B).
(B) A person who violates subparagraph (A) shall, for each alien
in respect to whom such a violation occurs -
(i) in the case of a violation of subparagraph (A)(i) or (v)(I)
or in the case of a violation of subparagraph (A)(ii), (iii), or
(iv) in which the offense was done for the purpose of commercial
advantage or private financial gain, be fined under title 18,
imprisoned not more than 10 years, or both;
(ii) in the case of a violation of subparagraph (A)(ii), (iii),
(iv), or (v)(II), be fined under title 18, imprisoned not more
than 5 years, or both;
(iii) in the case of a violation of subparagraph (A)(i), (ii),
(iii), (iv), or (v) during and in relation to which the person
causes serious bodily injury (as defined in section 1365 of title
18) to, or places in jeopardy the life of, any person, be fined
under title 18, imprisoned not more than 20 years, or both; and
(iv) in the case of a violation of subparagraph (A)(i), (ii),
(iii), (iv), or (v) resulting in the death of any person, be
punished by death or imprisoned for any term of years or for
life, fined under title 18, or both.

So, at the minimum, the members of the clergy who provide sanctuary for illegal aliens would be facing jail time of 5 years. The mayors of the cities who provide sanctuary for illegal aliens, including those gang members, who through their activities cause the death of another person, could be facing the death penalty according to section (B) (iv).

8 U.S. Code section 1252c, Authorizing State and local law enforcement officials to arrest and detain certain illegal aliens, states:

(a) In general
Notwithstanding any other provision of law, to the extent
permitted by relevant State and local law, State and local law
enforcement officials are authorized to arrest and detain an
individual who -
(1) is an alien illegally present in the United States; and
(2) has previously been convicted of a felony in the United
States and deported or left the United States after such
conviction,
but only after the State or local law enforcement officials obtain
appropriate confirmation from the Immigration and Naturalization
Service of the status of such individual and only for such period
of time as may be required for the Service to take the individual
into Federal custody for purposes of deporting or removing the
alien from the United States.
(b) Cooperation
The Attorney General shall cooperate with the States to assure
that information in the control of the Attorney General, including
information in the National Crime Information Center, that would
assist State and local law enforcement officials in carrying out
duties under subsection (a) of this section is made available to
such officials.

These sanctuary policies are against these two sections of U.S. Code. My question is this, why haven’t you, and/or the Attorney General of the United States upheld these EXISTING laws?

I would also like to cover the misconception that we need a guest worker program. As previously stated, we already have an estimated 12-20 million illegal aliens inside the United States at this time. I would venture to say it is closer to 30-40 million as there is no effective means of counting them.

With those kinds of numbers, why do we need more workers? Aren’t there enough already? We already have a guest worker program with the H2A visas. I have friends who have told me that without migrant workers their fruit would not get picked. I can accept that fact and would allow for workers to come to our country and do that type work. However, when they take jobs that used to be held by American workers at meat packing facilities, construction, and landscaping jobs, that is where I draw the line. The employers of these workers are only concerned with increasing their profits, not the welfare of the American workers.

Our existing law already provides for a guest worker program. It is found in 8 U.S. Code, Section 1188.

Admission of temporary H-2A workers

(a) Conditions for approval of H-2A petitions
(1) A petition to import an alien as an H-2A worker (as defined
in subsection (i)(2) of this section) may not be approved by the
Attorney General unless the petitioner has applied to the Secretary
of Labor for a certification that -
(A) there are not sufficient workers who are able, willing, and
qualified, and who will be available at the time and place
needed, to perform the labor or services involved in the
petition, and
(B) the employment of the alien in such labor or services will
not adversely affect the wages and working conditions of workers
in the United States similarly employed.

The Secretary of Labor may not issue a certification under
subsection (a) of this section with respect to an employer if the
conditions described in that subsection are not met or if any of
the following conditions are met:

(3) The employer has not provided the Secretary with
satisfactory assurances that if the employment for which the
certification is sought is not covered by State workers'
compensation law, the employer will provide, at no cost to the
worker, insurance covering injury and disease arising out of and
in the course of the worker's employment which will provide
benefits at least equal to those provided under the State
workers' compensation law for comparable employment.

(4) The Secretary determines that the employer has not made
positive recruitment efforts within a multi-state region of
traditional or expected labor supply where the Secretary finds
that there are a significant number of qualified United States
workers who, if recruited, would be willing to make themselves
available for work at the time and place needed. Positive
recruitment under this paragraph is in addition to, and shall be
conducted within the same time period as, the circulation through
the interstate employment service system of the employer's job
offer. The obligation to engage in positive recruitment under
this paragraph shall terminate on the date the H-2A workers
depart for the employer's place of employment.

Finally, S. 1348 would put into place employer sanctions for the hiring of illegal aliens. 8 U.S. Code, Section 1324a covers this area in great detail, it states:

Unlawful employment of aliens

(a) Making employment of unauthorized aliens unlawful
(1) In general
It is unlawful for a person or other entity -
(A) to hire, or to recruit or refer for a fee, for employment
in the United States an alien knowing the alien is an
unauthorized alien (as defined in subsection (h)(3) of this
section) with respect to such employment, or
(B)(i) to hire for employment in the United States an
individual without complying with the requirements of
subsection (b) of this section or (ii) if the person or entity
is an agricultural association, agricultural employer, or farm
labor contractor (as defined in section 1802 of title 29), to
hire, or to recruit or refer for a fee, for employment in the
United States an individual without complying with the
requirements of subsection (b) of this section.
(2) Continuing employment
It is unlawful for a person or other entity, after hiring an
alien for employment in accordance with paragraph (1), to
continue to employ the alien in the United States knowing the
alien is (or has become) an unauthorized alien with respect to
such employment.
(3) Defense
A person or entity that establishes that it has complied in
good faith with the requirements of subsection (b) of this
section with respect to the hiring, recruiting, or referral for
employment of an alien in the United States has established an
affirmative defense that the person or entity has not violated
paragraph (1)(A) with respect to such hiring, recruiting, or
referral.

It may be argued that S. 1348 had improved methods of ensuring that those working here were authorized to do so, but in 8 U.S. Code, Section 1324a subsection 6(C) (c) it states:

(c)No authorization of national identification cards
Nothing in this section shall be construed to authorize, directly
or indirectly, the issuance or use of national identification cards
or the establishment of a national identification card.
(d) Evaluation and changes in employment verification system
(1) Presidential monitoring and improvements in system
(A) Monitoring
The President shall provide for the monitoring and evaluation
of the degree to which the employment verification system
established under subsection (b) of this section provides a
secure system to determine employment eligibility in the United
States and shall examine the suitability of existing Federal
and State identification systems for use for this purpose.
(B) Improvements to establish secure system
To the extent that the system established under subsection
(b) of this section is found not to be a secure system to
determine employment eligibility in the United States, the
President shall, subject to paragraph (3) and taking into
account the results of any demonstration projects conducted
under paragraph (4), implement such changes in (including
additions to) the requirements of subsection (b) of this
section as may be necessary to establish a secure system to
determine employment eligibility in the United States. Such
changes in the system may be implemented only if the changes
conform to the requirements of paragraph (2).
(2) Restrictions on changes in system
Any change the President proposes to implement under paragraph
(1) in the verification system must be designed in a manner so
the verification system, as so changed, meets the following
requirements:
(A) Reliable determination of identity
The system must be capable of reliably determining whether -
(i) a person with the identity claimed by an employee or
prospective employee is eligible to work, and
(ii) the employee or prospective employee is claiming the
identity of another individual.

The fines for violating this section of our law are as follows,
(f) Criminal penalties and injunctions for pattern or practice
violations

(1) Criminal penalty
Any person or entity which engages in a pattern or practice of
violations of subsection (a)(1)(A) or (a)(2) of this section
shall be fined not more than $3,000 for each unauthorized alien
with respect to whom such a violation occurs, imprisoned for not
more than six months for the entire pattern or practice, or both,
notwithstanding the provisions of any other Federal law relating
to fine levels.

So again, I ask you, as an elected representative of the lawful citizens of the United States, who has taken an oath to uphold the Constitution, which states that all laws passed under it shall be the supreme law of the land, why haven’t you enforced these existing laws? Why must we, the American people be made to suffer the consequences of granting 12-20 million illegal aliens a pathway to that most precious gift, citizenship?

If you can explain to me why these laws were never enforced and convince me why we should trust you this time, I might reconsider my opposition to any new immigration reform. Until then I will fight this to my last breath.

H1B visas, Outsourcing and S 1348

When the Senate returns from break next week they will renew their debate on S. 1348, the Kyl/Kennedy immigration bill. One of the proposals contained in this bill is an increase in the number of H1B visas.
Article Here

Currently we allow for about 65,000 H1B visas per year. Under the new Kyl/Kennedy immigration reform proposal that number would skyrocket up to 180,000 per year, almost tripling the number of H1B visas granted per year.

Senator Bernie Sanders of Vermont has already introduced an amendment that would increase the fees for H1B visas from $1500 to $8500. Senator Sanders cited evidence that certain U.S. companies admit to hiring foreign H1B workers over Americans because those workers are willing to work for less money than American workers.

As far back as 2003 many of our software companies were outsourcing jobs, mostly to India. A Washington Post article stated that more than half the Fortune 500 companies were outsourcing software development jobs.

Duke Universities Pratt School of Engineering sent out surveys to 100 companies who outsource for their employees. The results of their findings are located at
Article here, and you can see that on a scale of 1 to 5, with 1 being no advantage and 5 being a significant advantage, that the cost of salaries and personnel savings was the highest ranked reason for outsourcing for employees at 3.83 on their scale.

However, if you watch the news, you are still led to believe that our companies need these workers because there is a shortage of skilled laborers in this country. We are told that we need these highly skilled workers to fill the high tech jobs that American is creating to compete in the global marketplace.

First of all, according to the Dept. Of Education, our colleges graduate around 300,000 students a year with Bachelors, Masters, or PhD's in computer or information sciences and math and engineering studies.

The Dept. of Labor estimates that, annually, there are only 120,000 job openings per year for the jobs that require degrees in higher education like the ones our students are graduating from in the United States.

So, where is the shortage of workers? Many say that these college graduates would all be entry level employees who require years of training to become proficient on the job, therefore they need H1B workers from abroad to fill these positions.

Not so. The office of U.S. Citizenship and Immigration Services awards H1B visas by random drawing. Fifty six percent of H1B visas are rewarded to entry level workers. On top of that, 84% of H1B visa workers earned wages that were below the median U.S. wage. In tech worker positions, the H1B counterparts earned $12,000 less per year.

Still, we are told that our children are not able to compete in the global marketplace because the education they are receiving is not up to par with the rest of the world. President Bush stated that "...we can make sure our children are prepared for the jobs of the future, and our country is more competitive by strengthening math and science skills."

In an article at Tech News World we were told that the President endorsed a proposal by Education Secretary Margaret Spellings to train 70,000 new math and science teachers...to improve basic education in these disciplines overall.
Article here.

There are many stories of people who have lost their jobs due to companies outsourcing to companies in India and China. Here are a few of them which ought to be sufficient to prove that American workers are being laid off solely for the benefit of the corporations, with little regard to the workers of this country.

In 1996, Natasha Humphreys received her college degree from Stanford University and went to work for Apple Computers. She took additional classes in technology so that she could move up the career ladder and was eventually rewarded by becoming a senior software testing engineer in the Palm Pilot program. In 2002 Palm Pilot decided to move all software testing to India and China were they could pay wages as low as $2 an hour. Natasha was sent to India to conduct training. She was assured that her job would not be affected. She spent two weeks in India training workers and then six months mentoring them from the United States. In 2003, Natasha was laid off, as well as 40% of her co-workers.

In 2005, Delphi, an auto parts giant which is a spin off of G.M. filed for bankruptcy. They claimed they were paying their workers between $26- $30 an hour and they wanted to cut costs by cutting wages, health care, and retirement. The CEO said he hoped to get wages down to the $8-$10 an hour range, and he also said he hoped to use the outsourcing of cheap laborers as well.

And finally, Fox News reported on a particularly tragic example of job displacement that took place in 2003: "Kevin Flanagan, a computer programmer with Bank of America, was fired from his job after being forced to train his replacement, an Indian worker who was taking over Flanagan’s job as part of Bank of America’s effort to replace its American workforce with foreign labor. Flanagan walked outside into his office parking lot and shot himself to death."
Article here

Yet if Bill Gates had his way, the caps on H1B visas would be done away with entirely, leaving all American workers susceptible to replacement by lower paid foreign workers.

To top off the insult of having our jobs sent overseas to be filled by workers who will work for significantly less than Americans will work for, there is this.

According to Senator Byron Dorgan, the U.S. tax code gives big business a tax break when they move their operations overseas. If a company moves it’s operations to China, India, or any other foreign country for that matter, they do not have to pay taxes on their earnings as long as that money stays overseas. Once the companies decide to bring their profits back to the U.S., they are charged only 5-1/4%, less than half of the tax rate for the lowest income families in the U.S.

Now tell me that if a company can get away with moving jobs overseas and hiring workers in China for $.30 an hour, then receive a tax break like that, whose side is our government on? It certainly isn’t the side of the American workers!

But alas, only a few voices in Congress are willing to speak out about the loss of jobs to Americans due to outsourcing, and insourcing of cheap foreign workers. The rest of them are beholden to their corporate masters, and as long as the American public continues to believe in their lies and deceptions, they will continue to hold office and sell the American people down the toilet for corporate profits.

Send these out to your elected officials

What are they thinking

Sometimes I wish I was a Vulcan. I would love to be able to do the Vulcan mind meld and see what is going on in the minds of our elected representatives. I would be particularly interested in seeing into the minds of the twelve Senators who, behind closed doors, came up with S. 1348, the Grand Compromise immigration legislation that is now being debated on the Senate floor.

Speaker of the House Nancy Pelosi made the following comment the other day, "...the American people are very wise on this, and their wisdom will be reflected in the actions of Congress." Obviously certain Senators, including Ted Kennedy, Harry Reid, Mel Martinez, Ken Salazar, John McCain, Lindsey Graham, Jon Kyl, Dianne Feinstein, and Arlen Specter among them, decided that they would hold closed door meetings to formulate what they considered was an immigration reform bill they felt was in the best interests of our country, or did they?

When an overwhelming 80% of the American people are against this proposed legislation it would appear that Speaker Pelosi's words don't quite ring true, the actions of the Senate do not reflect the will of the people.

If that is the case, just who are our senators representing with this immigration reform plan? How about Carlos Gutierrez, the Secretary of the U.S. Department of Commerce for one. Secretary Gutierrez was born in Cuba and studied business administration in Mexico. He played a key role in pushing through CAFTA, which has done nothing to improve the economy or the job markets in the United States.

Then there is the Catholic Church, in particular the Archdiocese of Los Angeles, Cardinal Roger Mahony. Cardinal Mahony is a strong proponent of amnesty for illegal aliens and has been very vocal about the church being a sanctuary for those who face deportation. The Cardinal, with his meddling in policy making, obviously does not understand the concept of the separation of church and state.

Then there is the National Council of La Raza. The National Council of La Raza, or "The Race," was condemned last year by Rep. Charles Norwood, R-Ga., as a radical "pro-illegal immigration lobbying organization that supports racist groups calling for the secession of the western United States as a Hispanic-only homeland." In a Washington Post article it was said that, "... La Raza, MALDEF, the League of United Latin American Citizens, or LULAC, and the National Immigration Forum are part of a broad network of immigrant rights groups that have been speaking daily with top aides in the offices of Democratic Sens. Ted Kennedy and Harry Reid, the Senate majority leader."

So now we have big business pushing for an endless supply of cheap laborers, the church looking to feed and grant sanctuary of the world, and Hispanic rights groups who want their land back, being represented by our Senate. What about the people who elected these Senators in to office, where is our representation?

Cecilia Munoz, Vice President of the National Council of La Raza stated that, "It is important that we get a good bill over the finish line." Good for whom I ask, certainly not the citizens of the United States.

Senator Spector, one of the authors of this bill says it is not amnesty, it will restore the rule of law to this land. Restore the rule of law? Since 1952, when Congress passed the McCarran-Walter Act, we have had the laws in place to control illegal immigration. They can be found in Title 8 of the United States Code. The laws are there, the will to enforce them are not. To prove my point I refer to something said by Senator Kennedy. The esteemed Senator stated that his bill would "say no more worker abuse", and employers would have to ensure they only hired legal workers. Shortly thereafter the Senator complained about an immigration raid at a New Bedford, Massachusetts company that, “disrupted the lives of scores of families who had laid down roots...” How strong is the Senators will to enforce any immigration law when he won’t enforce the ones we already have?

The Senator also stated, at the press conference that was held when they announced a compromise had been reached, that this bill would bring these workers out of the shadows and into the sunshine of America. Were these illegal aliens in the shadows two years ago in May when they took to the streets and demanded rights they are not entitled to?

If you look at this legislation that was formulated by these masters of the universe, as Senator Jeff Sessions calls them, you will see that it is a disaster waiting to happen. Let's take a look at what kind of compromise our elected officials decided was in our best interests. You may want to sit down for this.

According to current immigration procedures, a prospective immigrant to this country must undergo a physical exam prior to being issued a visa. For the approximately 12-20 million illegal aliens in this country already, that requirement would be waived if this bill passes.
All background checks on those applying for amnesty must be completed within 24 hours, although there is no justification why and plenty of reason to suggest that complete background checks can't be done so quickly.

Gang members would be given amnesty if they renounce their gang membership. If an illegal alien is arrested in an enforcement raid and might be eligible for amnesty, the government must provide help in applying for the Z visa and release the illegal alien.

Illegal aliens would be required to pay a $5000 fine, Illegal aliens are already faced with a $5,000 fine (19 USC 1459 and 19 USC 1433), but this fine is not enforced.

"If passed, this bill will make taxpayers pay the legal bills for illegal aliens seeking amnesty...." - Ken Boehm, Chairman of the National Legal and Policy Center (NLPC), May 22, 2007.

Section 413 promises U.S. help in getting financial services to Mexico's poor and under-served populations, expanding effort to reduce the transaction costs of remittance flows, helping the Mexican government to strengthen education and job training, and increasing health care access for the poor in Mexico.

Over the next 13 years alone, it would increase the current number of legal foreign-born green card holders from about 25 million (who arrived over 75 years) to around 50 million.

"...The White House misleads with its claims that the amnesty recipients won't get welfare benefits. For the first decade or so they are in the United States, the adults can't get means-tested welfare benefits but their children could. And after that first decade, the adults get to partake of the welfare state as well. For the next 40 years, notes Mr. Rector, they are eligible "for every single type" of these welfare benefits." "So the bottom line is that each of these households receives about $30,000 in government benefits, pays about $10,000 in taxes, at a net cost of around $19,000 per year [after rounding]. That's the equivalent of buying each of these households an automobile and every year of their lives as long as they're in the United States." (The immigration time-bomb Washington Times editorial, May 23, 2007)

The bill would also call for a biometric, tamper proof, identification card that could be used to verify their identity and immigration status for employers. There already is such a system in place at U.S./Mexico border at San Diego. It is so time consuming that it is only used about 2% of the time. Plus, without a thorough background check, which cannot be done in 24 hours as stated in the bill, there is no way to verify exactly who is applying for this new Z visa. With all the false documents these illegal aliens have been using to live and work in the United States for all these years, who knows who we will be allowing to live and stay here legally?

Those are just a few of the provisions in this monstrous bill that is far worse than the amnesty granted in 1986. At least President Reagan had the decency to call and amnesty an amnesty. Under the leadership of these 12 Senators and our president we have been lied to and betrayed.
In closing, I want to remind you of something said by Senator Kennedy back in 1986, when we granted amnesty to approximately 3 million illegal aliens. The Senator said, “This amnesty will give citizenship to only 1.3 million illegal aliens. We will secure the borders henceforth. We will never again bring forth an amnesty bill like this.” He said it once and he lied. Now he, along with 11 other traitors, are offering up another amnesty. Are you going to sit idly by and allow this to become law? Even more important, are you going to sit back and allow these, so called, elected representatives remain in office?

A couple letters

Congresswoman Pelosi,

I just saw a news broadcast in which you made the following comment, "...the American people are very wise on this, and their wisdom will be reflected in the actions of Congress."

I believe you were referring to the fact that over 60% of the American people feel we were wrong to take military action in Iraq, and that 63% of us want a timetable for the withdrawal of our troops from Iraq.

I find it amazing that you support the views of only 60% of the American people on this issue, yet an overwhelming 80% of the American people do not want amnesty for illegal aliens and the same number want our current immigration laws enforced and our border secured. Yet apparently the American people are not wise enough on this particular issue for you to pay attention to what we want.

Senator Obama,

Recently you made some comments regarding the point system provision in S 1348. You stated that it "constitutes at minimum a radical experiment in social engineering and a departure from our tradition of having family and employers invite immigrants to come."

Sir, I do not know if you are deliberately trying to mislead the people of this country concerning the history of immigration, or if you are just unaware of the facts on the issue. Whatever the case may be, it was an asinine statement to make from someone running for the office of President of the United States.

If you look back through every piece of legislation enacted regarding immigration to the United States, you will find that, prior to 1965, they all tried to establish quotas or even exclude certain nationalities or groups of people from immigrating to this country.

The very first immigration law passed in this country was the United States Naturalization Law of March 26, 1790 (1 Stat. 103). This law limited naturalization to aliens who were "free white persons", which left out indentured servants, slaves, and free African-Americans. It also limited naturalization to persons of good moral character.

In 1795 the Naturalization Act of 1790 was repealed and replaced by the Naturalization Act of January 19, 1795 (1 Stat. 414). Some of the changes this Act made were that the period of residence was increased from two to five years in the country and two years in the state of residence. The other major change was that, as well as taking an oath to support the Constitution, the immigrant had to renounce his former sovereign. This Act also reaffirmed that citizenship was for "whites" only.

On July 9, 1868, the 14th Amendment to the Constitution was ratified. It was part of the Reconstruction Amendments passed after the Civil War. It's goal was to provide citizenship for the children of freed slaves, thereby giving them the same rights as previously held by whites only.

On May 19, 1921, Congress passed the Emergency Quota Act (ch. 8, 42 Stat. 5), otherwise known as the Johnson Quota Act. This limited the number of immigrants who could be admitted from any country to 2% of the number of persons from that country who were already residing within the United States according to the 1910 census.

The Immigration Act of 1924 was next to be passed. Its goal was to limit the number of immigrants coming from southern and eastern Europe. It also excluded East Asians and Asian Indians from immigrating entirely.

In 1952 Congress passed the McCarran-Walter Act, otherwise known as the Immigration and Nationality Act of 1952. It codified, under title 8 of the U.S. Code, all immigration laws. It set all requirements for citizenship and penalties for illegal immigration and the hiring of illegal immigrants. Eventually, the INA established a preference system which selected which ethnic groups were desirable immigrants and placed great importance on labor qualifications.

As you can see, all these immigration laws were, as you state, "...a radical experiment in social engineering..." Our immigration laws were written to ensure that the American people were always to be a majority of the populace. The goal was to ensure that no immigrant group ever obtained majority status and disrupt the social fabric of our culture.

Ever since, your esteemed colleague, Senator Kennedy assisted in opening the Pandora's box of immigration without quotas the American people have suffered due to the effects of illegal aliens. Now we are asked to forgive and forget one more time.

I am sorry sir, but the American people, not the citizens of Mexico or racist groups such as the National Council of La Raza, are the people whom you serve. We declare with an overwhelming voice that we do not want an amnesty and we want our current laws enforced.

A week to save our country

A Week to Save Our Country
Neal Ross
May 19, 2007

Last week, members of the U.S. Senate held a news conference and announced that they had worked towards a compromise and finally had made a deal concerning immigration reform. The usual members of pro immigration lobby were in presence, Senators Kennedy, McCain, Feinstein, and of course their mouthpiece Senator Harry Reid of Nevada.

Although the proposed legislation has the backing of the President, it still has a long uphill battle before it becomes law. It must make it through the House, which is highly unlikely. House Speaker, Nancy Pelosi has already stated that without 70 Republican votes there will be no immigration reform legislation passed by the House. So this law has a tough road ahead, irregardless, the point is that these Senators, who have ignored illegal immigration for so long, and who have now been pushed into a corner by the publics outrage about the growing numbers and affects of illegal aliens in this country, would make this deal and call it progress. This bill, if it ever becomes law would mean the death of the United States as we know it.

The Senate Majority Leader has already said he hopes for a vote by Memorial Day. The legislation is not even finalized and promises to be at least as long as S. 2611, last years failed attempt at immigration reform. That bill was 700 plus pages. This bill may end up being one thousand pages. How are our Senators to be expected to read a monstrosity that big in under a week?

I am reminded of something James Madison once said, "It will be of little avail to the people that the laws are made by men of their own choice if the laws be so voluminous that they cannot be read, or so incoherent that they cannot be understood."

For months now there has been an almost subliminal attempt to prime the American people so that they might accept this bill when it finally came out. Various groups, chief among them the Archdiocese of Los Angeles, Cardinal Roger Mahony, have been trying to play up to our sympathies by stating that this is a matter of compassion. We are being told we should open our arms to the poor of the world and embrace them into our country and communities.
At the same time that Cardinal Mahony has been making these aliens out to be innocent victims, the 2008 Presidential race has been running full swing. Two GOP debates have taken place, and they have been formatted so as not to allow candidates sufficient time to address any issue in depth. This hurts candidates, like Tom Tancredo, who understand the devastating effects of illegal immigration upon our country.

So on the one hand we are being fed feel good gobbly-gook by the Cardinal from Los Angeles, and on the other we are being denied an opposing point of view from people who would rebuke the Cardinal.

As Cardinal Mahony said, we should feel compassion for these illegal aliens. Compassion and charity are commendable features, however they are personal features that each individual should demonstrate due to their beliefs and moral character. To mandate it of the people takes away the blessings and rewards of doing so of your own free will. The same goes for this immigration reform.

This compromise that was reached by our Senators has yet to even be written, and they are expecting a vote on it by next week. That is hardly sufficient time to examine it closely for flaws, and more importantly for its fiscal impact. This amnesty, and make no mistake about it, that is exactly what it is, has been estimated to cost the U.S. taxpayers trillions of dollars to implement.

Although the American people are divided on what exactly to do about illegal aliens, an overwhelming number, almost 80%, are against amnesty. That means we would be forced, not only to accept something we are against, but to pay for it as well with our tax dollars. Thomas Jefferson said, “To compel a man to subsidize with his taxes the propagation of ideas which he disbelieves and abhors is sinful and tyrannical.” Yet that is exactly what is happening.

In 1970 there were 203 million people in this country and we had reached what is called below replacement fertility. That means that American women were having less than 2.3 children per family. To sustain population growth, for each family there must be enough children born to replace both parents as they die off and add at least one more child as well. Without that fertility rate, the population either stabilizes or decreases.

By the year 2000 the population of Americans had reached about 220 million, but due to immigration the actual number of people in this country was 240 million. By the year 2050, as the baby boomers and some of their children begin to pass away, the population of Americans will begin to decrease from a high of around 250 million in the year 2020, to around 236 million in the year 2050. However the total U.S. population, if we continue with our current path of legal and illegal immigration will be around 420 million. These numbers are directly taken from the U.S. Census Bureau’s mid range projections which were calculated in 2002.

Those statistics show that we are committing cultural suicide in our efforts to show compassion upon the poor of the world. We are slowly but surely giving our country away to foreign born immigrants.

The focus of illegal immigration and the reform of our immigration system has been mostly upon Mexico. That is not to say that there are not illegal immigrants in our country from all over the world, there are. However the focus has been on Mexico. Why else would President Bush speak to the people of Mexico on a recent trip and promise to pass immigration reform legislation? That is where our focus lies, whether it is justified or not. Face it, according to statistics recently released by the U.S. Census Bureau, the Hispanic population in America grew by 3.6 percent, three times higher than the total population.

http://www.census.gov/Press-Release/www/releases/
archives/population/005164.html

What about the rest of the world? Are there not other countries that have poor people needing our compassion as well? There are 4.6 billion people in the world who are even more impoverished than the people of Mexico. At our current rate of taking in about one million immigrants from poor impoverished countries we will have little effect on easing the poverty of the world. Immigration cannot solve the worlds problems with poverty because each year as we take in one million of the poor, these countries add another 80 million to their population by new births. It is exponentially impossible to ease the burden upon these countries by immigration. Therefore compassion is a futile excuse for our immigration policy and any talk of reforming it.

The fact of the matter is this, our elected officials have been negligent, almost criminally so, in their refusal to enforce the immigration laws and policies we already have in place. The American people have been paying the price for their failure and have finally held them to task for their failures. Now in an effort to make it look like they are doing something, they offer us this ‘Grand Compromise’ and expect us to buy it hook, line and sinker.

We were told something very similar in 1986, when President Reagan passed the Immigration Reform and Control Act, IRCA. One of the authors of this current legislation, Senator Edward Kennedy, made the following comment about IRCA, "Out of deference to the critics, I want to comment on...what the bill will not do. First, our cities will not be flooded with a million immigrants annually. Under the proposed bill, the present level of immigration remains substantially the same..” He is hoping that we will not remember. He is hoping that we will accept the proposal for the death of our country that he and his comrades have come up with.

It is up to each and every one of us to make sure that this compromise does not become law. We need to call our elected officials, day in and day out, for the next week, until their phone lines melt from the volume of calls. We need to make our voices heard with a resounding NO in regards to this compromise which is a slap in the face to every American in this country. If we don’t succeed in stopping this, our country is doomed. It’s your choice. I have called twice this morning and am going to call again and again until they hear me loud and clear. How about you?

Memorial Day

Memorial Day is just around the corner. For many Americans the day is nothing more than the beginning of the summer season, a time for barbecues and trips to the lake. For those of us who truly love our country it is a time of thanks for the ultimate sacrifice untold thousands of people made in the defense of their country.

The state of affairs in our country today makes me wonder, were those deaths in vain? Has our country strayed so far from the principles upon which it was founded that those who died in its defense would no longer recognize it?

We have a government that seems to have forgotten that we are the employers and they are there to serve We the people, not the other way around. Our voices are ignored and the best interests of our country are sold down the drain to multinational corporations and special interests.

So, on this Memorial Day, I would like to ask that each of you reading this, get out a copy of the Constitution and read through it. Familiarize yourselves with the duties and limitations it places upon our government. Then remember that these elected officials only stay in office because you continue to vote for them. Then think about the lives lost defending this country and the principles outlined in that document. It is up to you to ensure that those who died, did not do so in vain.

Rudy Giuliani vs Ron Paul

At the recent GOP debate held in South Carolina, there was a brief confrontation between former New York Mayor Rudy Giuliani and Congressman Ron Paul of Texas. Fox News is claiming that Congressman Paul implied that the U.S. had a hand in the attacks of 911. That is absolutely not true, as anyone who saw the debate can verify.

Congressman Paul said, and I quote, "They attack us because we've been over there. We've been bombing Iraq for ten years. We've been in the Middle East...I think Reagan was right, we don't understand the irrationality of Middle Eastern politics." Mayor Giuliani then defined his interpretation of Congressman Paul's comments by saying, "That is an extraordinary statement as someone who has lived through the attack of September 11, that we invited the attack because we were attacking Iraq. I don't think I've ever heard that before, and I've heard some pretty absurd explanations for September 11." Mayor Giuliani received a round of applause for his rebuking of Congressman Paul.

A Fox News clip showed the confrontation and then continued by talking about the 9-11 truth movement. John Gibsons report stated that, "According to a recent Rasmussen Poll, 35% of Democrats think President Bush knew about the 911 attacks before hand. The so called 9-11 Truth Movement has already infected people like Rosie O Donnell, and one in three Democrats, and many other Americans, evidently including Congressman Ron Paul."

Correspondent Michelle Malkin afterwards says that Congressman Ron Paul really has no business being on stage as a legitimate representative of Republicans because the 9-11 truth virus is something that infect only a very small proportion of people that would identify themselves as conservative or republican..."

I remember after the attacks how we wanted answers. We called for investigations and we wanted to know how much the government knew beforehand. We got a report, the 911 Commissions Report. Why is it that Rudy Giuliani's testimony before the commission never made it into the final draft of the report for us to review?

The quote, unquote official 9-11 report is full of holes and unanswered questions. Congressman Paul did not state that the only reason we were attacked was because of our presence in the Middle East or our continued bombing of Iraq. He said we do not understand the politics of the Middle East. The Americans wanted the truth after 9-11. I am reminded of a line by Jack Nicholson in the film, A Few Good Men, "You want the truth? You can't handle the truth!" After the applause that Rudy Giuliani received by his rebuke to Congressman Paul, that is evidently the case for the majority of the people in this country.

Those of us who seek the truth in regards to 9-11 are labeled 'conspiracy nuts' or we have the 9-11 truth virus. We are shunned, scorned and looked upon as lunatics by asking for answers to questions that have never truthfully been answered.

President Bush laid the blame for the attacks of 9-11 upon the shoulders of Osama Bin Laden and his Al Qaeda terrorist network. It is coming up on 6 years since the attacks of 9-11 and we still have not succeeded in capturing or killing Osama Bin Laden. We have however entangled ourselves in wars in Iraq and Afghanistan with no visible end in sight. Meanwhile Osama Bin Laden hides safely in Pakistan, a supposed ally in our War on Terror.

The President and his propaganda machine have skillfully taken our minds off the fact that the attacks of Sept. 11 were done at the desire of Bin Laden, and slowly shifted the focus to, as of yet, undiscovered weapons of mass destruction in Iraq and their ties to Bin Laden's Al Qaeda network. We have created a much more hostile breeding ground for terrorist recruitment in Iraq and fueled the fires of Islamic hatred for the west. Well done President Bush!

Besides embroiling us in a war that can no longer be called a war, but a police action, what else has President Bush done to secure our country from further terrorist attacks?

He managed to pass the Patriot Act and the Military Commissions Act, which do away with just about every safeguard to our personal liberty as outlined in the Bill of Rights. He established a huge bureaucracy that is supposed to protect us but has done nothing to secure our nation from future attacks. Sure, we have to take off our shoes when we board an airplane and we can no longer bring nail clippers or scissors, but how much more secure are we?

Six foreign-born Muslims have been arrested for plotting an attack on the Fort Dix Army base in New Jersey. Investigators say the men planned to "kill as many soldiers as possible."

The only, I repeat the only reason we caught these six men is because they took a video tape of themselves calling for jihad against the United States to be copied and the employee at the store contacted the FBI. If they had not been so stupid as to make that video, who knows if they might had been successful? Does that make you feel any more secure?

Who were these men who threatened to ‘kill as many soldiers as possible’? They were all of Middle Eastern backgrounds. Two had been admitted to the United States legally by visas, and three were, get this, illegal aliens. These three men came to the U.S. by crossing the border near Brownsville Texas, more than twenty years ago! The whole while the New Jersey police department chose to look the other way regarding the status of illegal aliens in this country. I wonder how many more of these jihadists are out there just biding their time?

It appears that President Bush’s War on Terror is not as successful as we would like it to be. Could it be because we are fighting the wrong thing? This is were the American people are not ready to hear the truth. We are not at war with a nation, a people, or even a terrorist group. We are at war with an ideal, and ideal that is based upon an extreme interpretation of the religion of Islam. Until the people of this country realize that we are in a religious war for the very survival of our country, our beliefs and our lives, we cannot win this war! I am not saying all Muslims are going to become suicide bombers or take up arms like those who planned on attacking Fort Dix, but how can you know who is or who isn’t?

Did you know the word Islam means submission? Did you know the word Muslim means one who submits to Allah? According to the followers of Islam, they must follow the Qur’an. Chapter 9, verse 5 of the Qur’an states, “Those who reject Islam must be killed. If they turn back from (Islam), take them and kill them wherever you find them.”

I don’t think it can be explained any less clearly what the goals of the followers of this extremist version of Islam are in regards to the people of this country. Every man woman and child in this country who is not a follower of Islam is an enemy to the faithful and we must all be converted or killed.

Now, with that being said, are we fighting this war on terror as effectively as we could be? Not hardly! The people of this country are too concerned with being politically correct and not racially profiling people.

Our government has left our borders open to anyone who can sneak through, and now they want to grant amnesty to every one who successfully snuck in to our country, irregardless of their beliefs or their loyalty to the United States and our culture.

That is just plain naive and ignorant!

It is bad enough that allow so many people into this country from countries that practice Islam. As has already been shown, one of the Fort Dix planners was a natural born U.S. citizen and two were here legally on visas.

There is another report done by the World Almanac that states that there are approximately 5,220,000 Muslims in the United States as of 1991. Whatever the number was in 1991, it is sure to have climbed by now.

On top of that our government is allowing Iraqi refugees to come settle in the United States. On May 10, there was an article in the Washington Post Foreign Service, by Nora Boustany, which stated that House Democrats plan to introduce a bill that would increase by at least 20,000 the number of Iraqi refugees eligible for resettlement in the United States in 2007 and 2008. It would also admit 15,000 “special immigrant status” Iraqis and their families for each of the next four years.

These are people who are fleeing their country because of the conditions that were created by a war we started. Do you not think there might be just a tiny bit of anger towards the United States? As former President Bush used to say, I don’t think that is prudent.

Getting back to Rudy Giuliani, he states “If any Republican is elected president-and I think obviously that I would be the best at this-we will remain on offense and will anticipate what the {terrorists} will do and try to stop them before they do it.”

Well Mister Mayor, your offense sucks! You are soft on immigration. You allowed New York to remain a sanctuary city for illegal aliens, which may have included who knows how many jihadists. You are for granting amnesty for those already here. You support the president and his misguided war on terror in Iraq. The presidents position, and yours only add fuel to the fire and give them more incentive to bring the war to us. We are violating their sovereignty and forcing upon them belief systems that go against the extremist version of Islam that produces these terrorists we claim to be at war with. All we are doing is stirring a hornets nest by maintaining our presence in the Middle East. Congressman Paul is right and you and the rest of the American people do not wish to hear the truth.

If we want to be effective at fighting this war against terrorism, we need to reconsider who and what it is we are fighting and come up with a strategy to protect our nation from more attacks within, not from across the ocean.

Teddy Kennedy shot down in flames

Senator Kennedy,

I would like to thank your office for responding to my letter concerning illegal immigration. I honestly didn't expect a reply, considering I am not a constituent of yours. However, with that being said I would like to comment on some of the things you said in your reply.

You stated that illegal immigration is a complex issue that needs comprehensive reform. Sir, it is not complex and, although it might need reforming, it does not need the kind of reform you, Congressmen Flake and Gutierrez, or even President Bush have in mind.

You state that there are approximately12 million illegal aliens in this country, but I have read estimates that place it between 20-50 million. Who honestly knows how many illegal aliens there actually are in this country?

On that note I would like to remind you of something you, yourself, once said.
"Out of deference to the critics, I want to comment on...what the bill will not do. First, our cities will not be flooded with a million immigrants annually. Under the proposed bill, the present level of immigration remains substantially the same..."

Do you remember saying that? It was after a previous amnesty bill that was supposed to put an end to our problems with illegal immigration. Yet here we are, 21 years later with another batch of illegal aliens we don't know what to do with. I wonder sir, why do they keep coming if the Immigration Reform and Control Act of 1986 was supposed to fix all our problems?

You have again become a cheerleader for more 'comprehensive immigration reform' legislation. You are a co-sponsor of S.B. 2611 which would grant amnesty if certain conditions, such as back payment of taxes, were met. Whatever you choose to call it, it is still an amnesty, a forgiveness for crimes committed against the laws and the people of the United States of America.

Could it be sir that our elected officials in Washington are oblivious to what is going on outside the Beltway? Could it be sir that the people who are elected to represent the American people are in actuality representing the people of Mexico? Could it be sir that the people who take an oath to uphold the Constitution have never read Article 4, Section 4, which reads,
"The United States shall guarantee to every state in this union a republican form of government, and shall protect each of them against invasion..."

The only way to describe the number of illegal aliens who have been allowed to enter this country, is an invasion. Whatever the excuse of our elected officials, it is clearly a dereliction of their duty to protect the people of this country and therefore we should not be required to suck it up and stomach another amnesty to cover for your incompetence. We should be outraged and calling for the resignation of every single elected official who has not upheld their oath of office.

I have heard all the reasons for granting these aliens the right to stay here. They do the jobs Americans won't, it is time to bring them out of the shadows, they only want a better life.

I take great offense that I am expected to accept law breakers as people who should be considered eligible for any of the benefits this country has to offer. I take even greater offense at those who are elected to represent me, expect me and the other taxpayers of this country to subsidize these law breakers with tax funded services that were meant to be a safety net for American workers who come upon hard times. I take offense at being expected to learn another language because these people are unwilling to learn English. I take great offense when these criminals commit crimes in our cities and on our highways, then flee to Mexico to avoid prosecution, leaving American families to suffer the damages caused by these immigrants.

I know farmers who own fruit orchards, and they have in fact told me that they cannot get Americans to do the labor to operate their farms. So I can understand the need for immigrant laborers. However, using your estimate of 12 million illegal aliens, there should be no farm in this country that is in need of workers to pick their crops. Why then the need for any further Agricultural visas?

Could it be that the truth is that out of 12 million illegal aliens, only 4% are actually doing farm labor? Could it be sir, the other 96% are either taking jobs away from Americans, at much lower salaries, undercutting the wages for companies that do obey the law and hire American workers? I have almost 25 years experience working with electrical systems, but I cannot get a job as an electrician because I am not licensed. Yet there are Mexican workers pulling wires in new home construction in my area who have no experience whatsoever. Do not tell me they are doing the jobs Americans will not! I would, but am not allowed to because I will not work for minimum wage like these immigrants. Could it also be sir that they are working under the table but since they have a child in this country who, by the misinterpretation of the 14th Amendment, are automatic citizens, authorized to collect welfare, food stamps and a whole host of tax payer funded subsidies?

You see sir, I am not completely satisfied with your answer to my letter. You have tried to placate and pacify me, but it hasn't worked. I am still outraged at my governments lack of enforcement of existing laws and its attempt to force feed the American people another amnesty. I am sickened by its loyalty to the criminals who violate our sovereignty and its lack of loyalty to the people whom you represent.

Therefore this is the only immigration reform I will accept. Since our farmers do need workers to work the farms I propose the following. A guest worker program where citizens from Mexico can apply to work the fields in America. Notice I said citizens from Mexico, all illegal aliens living within our borders will be ineligible unless they reture to Mexico and apply through proper channels for a visa. However I must demand that these workers be paid at a decent wage of around $10 per hour. It can be done, the fruit farmers I spoke to all told me that they pay between $10-$11 an hour for their workers.

This is how the program would work. Any Mexican who wishes to work the fields in America would file an application, along with the filing fees. A background investigation would be performed, and if the applicant passed they would then wait, in Mexico, for an opening. Then when a farmer is in need of workers he could then contact the proper agency and inform them of how many workers were required. They would in turn select the required number of workers and issue them temporary visas. The workers would be fitted with a GPS tracking device upon their admittance to the United States. The employer would also pay a bond to ensure that they were returned to Mexico once their visa expired. The visas would be for the workers only. No family members, including wives. We do not want any more anchor babies born in this country which would allow these laborers to stay and collect benefits they are not entitled to.
At the end of the visa, the workers would return to Mexico. If they failed to return they could be located by their GPS tracking device and then located and deported, which would make them ineligible for further participation in the guest worker program.

If, during their stay in the United States, they are arrested for violating any of our laws, they would immediately be deported and, again be ineligible for future participation in the guest worker program.

These guest workers would not be eligible for any government subsidies while they are here. No food stamps, no welfare, no low income housing, no Medicaid. They would have to make do on the wages earned, just like we Americans are expected to.

If you think that is unfair, let me tell you a story. My wife is Filipina and her family has been unable to obtain visas to enter this country, although we have applied and followed all the proper requirements. Since we couldn't get them here, and since they are poor, we have spent a great deal of our own money to find them work abroad in places like Saudi Arabia, Qatar, and Dubai. They are now working abroad, away from their families for one year periods. They work seven days a week and bring home a paltry $260 a month. They have to abide by Islamic Law, which means they cannot drink alcohol or participate in any Catholic religious services. However they do it because for them that is good money compared to what they would make in the Philippines. They do it to support their families.

So, if we want guest workers they can come here under the same conditions. These workers are here to make a living and support their families, not partake of the American dream at the expense of the U.S. taxpayers.

The abovementioned guest worker program would be conditional of course upon full enforcement of all current existing immigration law. There is no need to reform our laws, just enforce them! U.S. Code, Title 8, Section 1324a states, "Any person who knowingly hires/harbors/transports any illegal alien is guilty of a felony punishable by 10 years jail + $2000 fine per illegal alien + forfeiture of the vehicle or property used to commit the crime".

If we enforced that, no one, and I mean no one would hire an illegal alien. However you, our elected officials have allowed that law to go un-enforced to increase the profits of big business, at the cost of the destruction of our culture and our country by the massive influx of illegal alien invaders.

Next, finish the fence along the U.S./Mexico border. I could care less if President Calderon or the Catholic Church cry like babies about human rights violations or any other lame excuse they might offer up to oppose such a fence. Unless Mexico takes steps on their own to stop the tide of humanity washing across our border every minute of every day, I don't care what they think. Our nations future is at stake and that is what should be on the forefront of your mind with every piece of immigration legislation you consider.

Finally, cut off all tax funded subsidies for illegal aliens. They do not have the right to collect anything from this country. Their children may very well be citizens according to the misrepresentation of the 14th Amendment but the parents are not. If the child is deserving, take it away from the parents and put it up for adoption to an American family and deport the parents. Either that, or allow the parents to take their children and return to Mexico on their own. However they are not entitled to any government funded services!

Thomas Jefferson once said, "To compel a man to subsidize with his taxes the propagation of ideas which he disbelieves and abhors is sinful and tyrannical." With upwards of 80% of the American people against illegal aliens receiving taxpayer funded subsidies, I would say our government is bordering on tyranny and violating their oath of office to uphold Article 4, Section 4 of the Constitution.

Once again sir, I thank your office for responding to my letter. You did not have to do so, as I am not a constituent of yours. However, you may want to rethink your position on any comprehensive immigration reform. You may want to begin talking to average American citizens to see how they feel on this issue. If you grant amnesty, however you wish to disguise it, to 12 million illegal aliens, you will only be opening Pandora's Box. You will create a future tidal wave of illegal aliens that is unlike anything we have yet to see. You will have once again shown your disdain for the people you are elected to represent, and finally you will have signed the papers that allows for the destruction of the United States of America as created by our founding fathers.

El Presidente Bush addresses his amigos

El Presidente Bush On Cinco de Mayo
Neal Ross
5 May, 2007

I would like to comment on the speech President Bush made at the White House on Cinco de Mayo. First off, did you notice who was in attendance? Attorney General Alberto Gonzales, Director of U.S. Citizenship and Immigration Services Emilio Gonzales, the Ambassador to Mexico Arturo Munoz-Ledo. Could that be a sign as to where our presidents loyalty lies?

As to what President Bush said in his speech, it was all designed to show you how great the contributions of the people of Mexico have been to our culture and our history. No mention was made about American ingenuity, American culture. Our contributions were entirely ignored and pushed aside as meaningless by this president, just as our thoughts and concerns are on the issue of illegal immigration.

President Bush said that, "We believe that both our nations have a responsibility to share the blessings of liberty." Mr. President, are you aware that even with all the oil wells in Saudi Arabia, Mexico has a higher Gross Domestic Product than the Saudis ? The economy of Mexico is the 9th highest in the world. If it is the responsibility of both countries to share in the blessings of liberty, when is the country of Mexico going to begin doing its part? Why don't they start amongst their own people?

The President went on to say, "Immigration has made our land a great melting pot of talent and ideas. It has made America a beacon of hope for people in search of a better life." Sir, immigration has made our country great. We are a nation of immigrants, but these immigrants came here legally and became Americans as Teddy Roosevelt once said in the following quote.

"From the melting pot of life in this free land all men and woman of all nations who come hither emerge as Americans and nothing else. They must have renounced completely and without reserve all allegiance to the land from which they or their forefathers came. And it is a binding duty on every citizen of this country in every important crisis to act solidly with all his fellow Americans, having regard only to the honor and interest of America, treating every other nation purely on its conduct in that crisis, without reference to his ancestral predilections or antipathies. If he does not act, he is false to the teachings and lives of Washington and Lincoln; he is not entitled to any part or lot in our country and he should be sent out of it."

In amongst the illegal aliens, that even though they have violated our laws by coming here illegally to find work, there are groups with various agendas of their own. There are the Hispanics who believe in Reconquista, the reacquisition of the land Mexico believes is rightfully theirs. How about the Mexica movement who say, “We say invasion, not discovery. We say stolen continent, not America. We say cultural castration, not assimilation. We say genocide, not Western expansion. We say racial rape, not mestizaje. We say theft, murder, racism and slavery, not capitalism.”

President Bush went on to say, “In Washington, we're now in the midst of an important discussion about immigration. Our current immigration system is in need of reform. It is not working.”

Mr. President, you are wrong. It is not our immigration system that is not working, it is our government. The president contradicted himself when he next said, “We need a system where our laws are respected.” That, Mr. President, is exactly what the problem is. Our laws are not respected, not just by the illegal aliens who cross our borders by the thousands, but by those in office who refuse to enforce them!

The President also said, “We need a system that meets the needs of our economy.”
I am forced to admit that our President hasn’t the slightest clue as to what our economy needs. For an economy to be strong and functioning we need a good middle class to buy the goods which drives business, and we need jobs in the manufacturing sector.

With the weakening of the middle class because of depressed wages due to companies hiring illegal workers at lower salaries, and the loss of manufacturing jobs to China and Mexico, our economy is ready to collapse. I believe the President is more concerned with corporate profits than the actual economy and how it affects the working citizens of this country.

Finally, the President said, “And we need a system that treats people with dignity and helps newcomers assimilate into our society.” Mr. President, how about treating the people of this country with some dignity? We pay your salary, we voted you into office, (at least some of us did). You swore an oath to uphold the Constitution of the United States. By your disregard of the concerns of the citizens of this country regarding illegal aliens, and your continued plan to force the American people to accept an amnesty package, and don’t you dare call it anything else, you have shown that the illegal aliens and the government of Mexico are the ones to whom you are loyal. Sir, I am ashamed to call you an American, let alone our President.

Immigrations Double Standards

If there is one thing that really got me upset, I think it would have to be double standards, rules that apply to some and not to others. Rules should to everyone equally, and that is why the whole issue of immigration and multiculturalism has got me so upset. People are dead wrong when they say that I am racist or xenophobic. I am about following rules, rules that should be applied equally to all.

America has been called the melting pot. People from all nations came to this country and became Americans. These people did not give up their cultural heritage, but they did assimilate into society in a way that produced citizens that were able to work and communicate together. That meant that they would all have to speak a common language and follow common laws.

People came to this country to partake of the opportunities that abounded within our borders. However, they did assimilate, they became Americans in every sense of the word. Their loyalty was to this country, not their native land. That is what made the concept of the melting pot so great, we took members from all races and nationalities and combined them all into a diverse, yet unified citizenry.

In 1782, Hector St. Jean Crevecoeur wrote a book entitled, Letters From An American Farmer. In it he states,

"…whence came all these people? They are a mixture of English, Scotch, Irish, French, Dutch, Germans, and Swedes... What, then, is the American, this new man? He is neither an European nor the descendant of an European; hence that strange mixture of blood, which you will find in no other country. I could point out to you a family whose grandfather was an Englishman, whose wife was Dutch, whose son married a French woman, and whose present four sons have now four wives of different nations. He is an American, who, leaving behind him all his ancient prejudices and manners, receives new ones from the new mode of life he has embraced, the new government he obeys, and the new rank he holds. . . . The Americans were once scattered all over Europe; here they are incorporated into one of the finest systems of populations which has ever appeared."

That is the melting pot which made America so great. All that has changed with the politically correct concept of multiculturalism. While multiculturalism may sound good, the application of its principles in America has done nothing but fragment society, dividing it along ethnic and racial lines. So instead of being a united people, we are a people divided by race. Again, I do not wish to imply that we are to forsake our cultural heritage, but for this country to survive, those who wish to reside here in America must, above all, agree to abide by the cultural and social rules and laws that made this country what it is.

Think about it for a moment. American cultural and social rules were followed by the people who made America such a great place to begin with. If those common cultural and social rules had not been followed America would not have become the great country it is, and no one would want to come here. So why the desire to do away with the very principles that made this country what is so appealing to people all over the world?

Getting back to my point, multiculturalism may sound great since it says that all races and cultures have something good to offer. Then, without being labeled racist, may I ask the following? Why is it that every race has some group or organization that promotes their culture, the advancement of their people, except for the white Anglo-Saxon Americans?

There is the National Council of La Raza for the Hispanics, the NAACP for the African Americans, the National Association of Arab Americans, the Hmong American Partnership, the Cultural Society of Filipino-Americans, and the India American Cultural Association, just to name a few.

Yet I dare you to deny that if I were to start a national organization called the Society for the Preservation of White American Values I would be attacked and labeled a racist and my organization would be picketed and protested until I was forced to close it down.

Is that equal treatment for all? It is clearly a case of double standards, and remember, I don’t like double standards under any circumstances.

Now this is where the subject of illegal aliens comes into play. These folks from Mexico that violate our immigration laws, then demand citizenship and all the rights that being an American citizen entails really get my blood boiling. It is not because I don’t think people should not be allowed to migrate to America, if they assimilate and become 100% American. No, I get mad because of the double standards. These people break our laws by entering this country illegally. They do not even have the decency to respect our law and yet they want to be treated as equals and given the same rights that people born here or naturalized receive? Why don’t we take a look at how we would be treated if we wanted to migrate to Mexico.

The following are all actual law in regards to immigration and naturalization in Mexico.
-Foreigners may be barred from the country if their presence upsets "the equilibrium of the national demographics," when foreigners are deemed detrimental to "economic or national interests," when they do not behave like good citizens in their own country, when they have broken Mexican laws, and when "they are not found to be physically or mentally healthy." (Article 37)

-Federal, local and municipal police must cooperate with federal immigration authorities upon request, i.e., to assist in the arrests of illegal immigrants. (Article 73)

-Foreigners with fake immigration papers may be fined or imprisoned. (Article 116)
-Foreigners who sign government documents "with a signature that is false or different from that which he normally uses" are subject to fine and imprisonment. (Article 116)
-Foreigners who fail to obey the rules will be fined, deported, and/or imprisoned as felons:
-Foreigners who fail to obey a deportation order are to be punished. (Article 117)
-Foreigners who are deported from Mexico and attempt to re-enter the country without authorization can be imprisoned for up to 10 years. (Article 118)
-Foreigners who violate the terms of their visa may be sentenced to up to six years in prison (Articles 119, 120 and 121).

-Under Mexican law, illegal immigration is a felony. The General Law on population says,
"A penalty of up to two years in prison and a fine of three hundred to five thousand pesos will be imposed on the foreigner who enters the country illegally." (Article 123)

Those are the laws regarding illegal immigration to Mexico. What is their law regarding becoming a citizen of their country?

Immigrant Permits are for people who wish to live in Mexico, short or long term.
You do not have to surrender your natural Citizenship to be granted full resident status in Mexico. Full resident status entitles you to all rights and benefits of a Mexican National (live, work, claim state benefits and to pay taxes) but you cannot vote in Mexican elections.

The following describes the different types of Non-Immigrant and Immigrant Permits.

Students

If you want to study in Mexico, a non-immigrant permit which enables you to live and study in Mexico can be granted by the Consulate. You must be able to prove your ability to be self-sufficient by showing a certain amount of funds in a bank account.

Listed below are the kinds of people who can apply for Immigrant Permits, with a view to taking up permanent residency in Mexico:

Retirees
If you are over 50 years of age, and want to engage in "non remunerative activities" and you are receiving funds from abroad (from a pension or other investments or fixed income) at least to the value of 400 times the daily minimum wage per month* and a further 200 times daily minimum wage per month for each dependent (e.g. spouse, children) then you can apply for a Retiree Immigration Permit.

Investors
You can receive an immigration permit if you are willing to invest your capital in Mexico. You investment can be directed at industry or services, and must equal a minimum of 26,000 times the minimum daily wage in Mexico City

Professionals
If you are a qualified professional, you can have your certificates validated by the Mexican Consulate and apply for an immigration permit to live in Mexico. You must be sponsored by a company who must satisfy the authorities that you are essential to their operative requirements.

Immigrant, Economically Active
(When you want to acquire permanent residency AND you want to work there)
You will need to satisfy the requirements for entry (e.g. professional, sponsored by a company, etc), or be able and prepared to invest at least 40,000 times the minimum daily wage in Mexico City (see above).

Immigrant, Not Economically Active
(When you want to acquire permanent residency but DO NOT want to work there)
If you are of retirement age (50+), and have at least US$1,500 or equivalent income per month, then a Retiree permit will be your easiest route.

So, you see that Mexico applies much more stringent immigration laws upon people wishing to reside in their country, then the illegal aliens, and even Presidents Fox and Calderon are demanding of the United States government. DOUBLE STANDARDS AGAIN!

I hope I have been able to explain that I am not against legalized immigration if those who come here truly wish to become Americans. I am against anyone who comes here and does not want to become American, anyone who comes here illegally and then demands all the rights and privileges of citizenship when all they deserve is to be sent home.

Illegal immigration is about the law, and double standards. If you cut through the emotional nonsense and examine the facts you will see that the citizens of this country who want our immigration laws enforced and no benefits for illegal aliens are only asking our government to apply the same rules the government of Mexico applies to people who violate their laws. This issue is not about race, although those who favor amnesty and open borders would tell you otherwise. If any charge of racism is to be leveled against anyone, it would be to all the groups and organizations which cry racism when Anglo Saxons stand up for their rights and privileges while these same groups are free to promote the benefit of their race and their culture.

Acceptable Immigration reform

I would like to comment on the continued push by President Bush and some members of Congress for comprehensive immigration reform. It has repeatedly been said that our immigration system is broken and needs to be reformed. I have a question regarding that statement. How can you tell if a system is broken if no one has every tried to enforce it to begin with?

In 1986, then President Reagan signed into law, the Immigration Reform and Control Act. That was supposed to fix all our problems with illegal immigration, a one time only amnesty. Here we are, 21 years later with another 20 million illegal aliens in our country, facing another amnesty.

Why should the American people shoulder the burden for our government's inept handling of the issue of immigration? Why should we accept 20 million citizens from Mexico, South America, and wherever else it is they come from because of our governments unwillingness to enforce the law?

President Bush should have sent the military to guard our border the day after 911. Instead, he chose to send our troops off to die in some far off land in a chase after phantom terrorists in Iraq. With an estimated million illegal aliens crossing the U.S./Mexico border annually, that is roughly 5 million illegal aliens the president has allowed to enter since he started this war on terror.

And now you are pushing for amnesty to cover for your mistakes, your ineptitude, your lack of action, even though an overwhelming 80% of the legal residents of this country oppose it.

Senator John McCain, a leading proponent of immigration reform and supporter of S. 2611, the Senates Immigration legislation, repeatedly stated that if anyone has a better idea he would listen and take it before the Senate for consideration. When attending a town hall meeting in Tempe Arizona, Senator McCain was asked about ‘attrition through enforcement’, a plan documented by Mark Krikorian of the Center for Immigration Studies. Senator McCain refused to consider it or even listen. It is attitudes like that that show the American people, that you, our elected officials have no regard, nor desire to enforce existing law. Your goal is to continue bringing in as many immigrants, legal and illegal into this country, to provide a continuous supply of cheap labor for the corporations of this country who fund your political campaigns. The wishes and desires of the American people are of little or no concern to you whatsoever.

This country was built by Americans. We did not put forth our sweat and blood so that elected officials could chose to ignore our wishes and give our country away to foreigners who have never contributed to our society or our culture.

So here is what I am going to do. I work with some Americans, some born and raised here, some naturalized, that also own farms and fruit orchards. They have told me that they have tried to hire Americans to work their fields and pick their fruit. In talking to them I have learned that there just are some jobs that Americans won’t do. So I can see the need for a guest worker program. However, for me to accept one it will have to be on terms that would guarantee me, and the rest of the American people, that it is going to work and not flood our nation with even more illegal aliens.

So here is what I propose. First off the Senate and the House must pass, and the President must sign into law H.R. 698 which would deny citizenship to children born to illegal aliens. That would stop the nonsense of these illegal aliens being eligible for food stamps, welfare, Medicare and a host of other free benefits paid for by the tax payers of this country. Next, every illegal alien currently in this country would not be eligible to participate in this guest worker program. If they wish to participate they must return to Mexico, along with their families and apply through proper channels. Finally, all employers who hire the remaining illegal aliens will be punished as per law, to include fines and prison time. Once these steps have been taken the following guest worker program could be initiated.

-All applicants for guest worker status must fill out the proper forms at a immigration center on Mexican soil. These forms, along with all required fees will be processed and a thorough background check and physical exam performed. Once the applicant is approved they will be added to a waiting list for an opening in the U.S.

-When an employer needs workers for his farm he will submit a request to the overseeing agency, stating how many workers he will need, how long he will need them and the wages he will pay them. The wages must be above the minimum wage, and their wages will be taxed just like any other worker in the U.S.

-When the overseeing agency approves the application, they will select the desired number of workers and the farmer will be required to pick them up at a designated border station. Upon entering the United States they will be equipped with a tamper proof Global Positioning Device which will allow us to locate them should they try and disappear into society or overstay their visa. Failure to follow the terms of their visa will deny them further participation in the guest worker program.

-The visa will be issued for the workers only. We are not issuing vacation passes for the entire family. If these people want to work then they can come here and do so, but their family will remain on the other side of the border.

-While employed in the U.S. these guest workers must abide by U.S. law. If they wish to drive they must apply for a valid drivers license, provide proof of insurance and have their vehicle smog checked like any other American citizen is required to do. If, during the course of their employment they violate our laws and are apprehended by law enforcement, they will be deported and lose the opportunity to participate in the guest worker program in the future.

-If, after numerous times working in the United States as guest workers, these people wish to become citizens of this country they may apply and wait in line like anyone else. They must have learned sufficient English to get by and be able to pass the citizenship test.

That is my guest worker program. It fits the needs of the agricultural industry and it also ensures the American people that we are not bringing criminals, or carriers of disease into our country. It also provides a way to track these workers in case they decide to overstay their visa, so that they can be located and deported.

I am just an average citizen, yet I was able to come up with a workable plan for guest workers. Why has it been so difficult for those elected to represent me, and millions like me to come up with something similar? I can tell you why, although you already know, you have no desire for the immigration system to work. Otherwise you would have been enforcing our current laws for the last 21 years, since IRCA.

You keep pushing for immigration reform and the American people have had enough of it. Your total disregard for our wishes is going to push us too far one day. The King of England once learned what happens when you disregard the people for too long. For your sake, I hope it doesn’t come to that once again.

Regarding sancutary cities

I would like to take some time to talk about the numerous 'sanctuary cities' that have recently made the news. Recently Mayor Gavin Newsom of San Francisco, and Mayor Ron Dellums of Oakland California publicly stated that their cities are sanctuary cites for illegal aliens. Special Order 40 in Los Angeles made it a sanctuary city. Executive Order 124 in New York City made it a sanctuary city. Houston, and even our nations capital, Washington D.C. are sanctuary cities. These cities all prohibit their law enforcement agencies from communicating with Immigrations and Customs Enforcement regarding suspected illegal aliens. These policies also prevent officers from questioning a suspect in regards to their immigration status.

The mayors of all these cities are in violation of numerous federal laws. The U.S. Constitution, Article 2, Section 8 states, "The Congress shall have power to...establish a uniform rule of naturalization" . Since the U.S. Constitution is the Supreme Law of the Land and it supersedes all other laws, it is the responsibility of Congress to create laws regarding immigration and naturalization.

The U.S. Constitution also says in Article 4, Section 4 that, “The United States shall guarantee to every state in this union a republican form of government, and shall protect each of them against invasion...”

Therefore, according to the Constitution, it is the responsibility of the federal government to pass and enforce immigration law. Our immigration law can be found in Title 8 of the United States Code.

Section 1644 of that code clearly states, "Notwithstanding any other provision of Federal, State, or local law, no State or local government entity may be prohibited, or in any way restricted, from sending to or receiving from the Immigration and Naturalization Service information regarding the immigration status, lawful or unlawful, of an alien in the United States."

Also, the federal Immigration and Nationality Act, INA 274A(a)(1)(A) states,
A person (including a group of persons, business, organization, or local government) commits a federal felony when she or he:

-assists an alien s/he should reasonably know is illegally in the U.S. or who lacks employment authorization, by transporting, sheltering, or assisting him or her to obtain employment, or

-encourages that alien to remain in the U.S. by referring him or her to an employer or by acting as employer or agent for an employer in any way, or

- knowingly assists illegal aliens due to personal convictions.

Penalties for violation of INA 274A(a)(1)(A) include, criminal fines, imprisonment, and forfeiture of vehicles and real property used to commit the crime.
Also, Title 18, Part I, Chapter 75, Section 1546 of the U.S. Code clearly states,

Whoever knowingly forges, counterfeits, alters, or falsely makes any immigrant or nonimmigrant visa, permit, border crossing card, alien registration receipt card, or other document prescribed by statute or regulation for entry into or as evidence of authorized stay or employment in the United States, or utters, uses, attempts to use, possesses, obtains, accepts, or receives any such visa, permit, border crossing card, alien registration receipt card, or other document prescribed by statute or regulation for entry into or as evidence of authorized stay or employment in the United States, knowing it to be forged, counterfeited, altered, or falsely made, or to have been procured by means of any false claim or statement, or to have been otherwise procured by fraud or unlawfully obtained; (emphasis added)

The penalty for violating this section of the U.S. Code is a fine or imprisonment of up to 15 years, or both.

Finally, Title 8, Chapter 12, Subchapter II, Section 1324 of the U.S. Code states that harboring illegal aliens is a crime.

Bringing in and harboring certain aliens

(iii) knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, conceals, harbors, or shields from detection, or attempts to conceal, harbor, or shield from detection, such alien in any place, including any building or any means of transportation;

(iv) encourages or induces an alien to come to, enter, or reside in the United States, knowing or in reckless disregard of the fact that such coming to, entry, or residence is or will be in violation of law;

The penalties for violation of this are as follows,

(B) A person who violates subparagraph (A) shall, for each alien in respect to whom such a violation occurs—

(i) in the case of a violation of subparagraph (A)(i) or (v)(I) or in the case of a violation of subparagraph (A)(ii), (iii), or (iv) in which the offense was done for the purpose of commercial advantage or private financial gain, be fined under title 18, imprisoned not more than 10 years, or both;

(ii) in the case of a violation of subparagraph (A)(ii), (iii), (iv), or (v)(II), be fined under title 18, imprisoned not more than 5 years, or both;

(iii) in the case of a violation of subparagraph (A)(i), (ii), (iii), (iv), or (v) during and in relation to which the person causes serious bodily injury (as defined in section 1365 of title 18) to, or places in jeopardy the life of, any person, be fined under title 18, imprisoned not more than 20 years, or both; and

(iv) in the case of a violation of subparagraph (A)(i), (ii), (iii), (iv), or (v) resulting in the death of any person, be punished by death or imprisoned for any term of years or for life, fined under title 18, or both.

In 2002, the U.S. Court of Appeals for the Second Circuit affirmed U.S. immigration laws and denied sanctuary as a defense, (USA v. Francine La May). Also in 1989 the Supreme Court upheld criminal convictions of sanctuary workers for violating immigration laws (USA v. Aquilar).

So, with all the evidence you can see that the mayor of any city that declares his city to be a sanctuary for illegal aliens is in violation of numerous federal laws and statutes.

My question then is this, where is our justice department in regards to this issue. These mayors are clearly in violation of numerous offenses, why have they not been taken into custody and charged for their crimes? By their inaction they themselves are complicit in the crime and should be charged as accomplices and imprisoned as well.

If the state legislators of these sanctuary cities had any respect for our laws, they would do as the state legislature in Colorado did. Written by Senator Tom Wiens, and signed by Governor Bill Owens, Colorado put into law Senate Bill 90. This measure prevents cities and local governments from implementing sanctuary policies by prohibiting grants to cities that declare themselves sanctuary for illegal aliens.

Our federal government could do the same. They could cut off all federal funds to the states that have sanctuary cities. That in turn would force the governors of those states to take action to repeal those policies, or imprison the mayors for their violation of our immigration law.

Nothing has changed, sanctuary cities still exist and flaunt their disregard for our laws and our national security by harboring these illegal aliens. All the way from the local level to the federal government the laws are disregarded, the will of the people ignored. For that I blame the American people for voting into office the same scoundrels who disregard their Constitutional obligations and cater to the special interests who demand a continuous flow of illegal aliens into this country. Unless the people of this country stop voting for these traitors nothing will change, American will be overrun by illegal aliens and we will no longer be able to call this country our own. I don’t intend to go down without a fight, do you?
