Flake Gutierrez Bill, amnesty in sheeps clothing

Our government is at it again. We now have been introduced to the Flake-Gutierrez Bill for immigration reform, otherwise known as HR 1645, The Security Through Regularized Immigration and a Vibrant Economy, (STRIVE) Act, introduced on the floor March 22, 2007.

In 1986 we were presented with the Immigration Reform and Control Act, (IRCA), which was signed into law by President Reagan. It was supposed to put an end to our problems with illegal aliens.

Senator Edward M. Kennedy made the following comments regarding all his previous attempts at passing immigration reform bills.

"Out of deference to the critics, I want to comment on...what the bill will not do. First, our cities will not be flooded with a million immigrants annually. Under the proposed bill, the present level of immigration remains substantially the same..."

He went on to say,

"Contrary to the charges in some quarters, S.500 will not inundate America with immigrants from any one country or area, or the most populated and economically deprived."
Finally, he stated,
"As I noted a moment ago, no immigrant visa will be issued to a person who is likely to become a public charge..."

How short are our memories? Senator Kennedy says that we will not be flooded with a million new illegal aliens a year. What does Senator Kennedy think 20 million illegal aliens is, a drip in the faucet?

Representatives Flake and Gutierrez are now promising us the same kinds of things with their STRIVE Act. Are we that stupid and our memories so short that we are going to believe them?
How many amnesties must we give before the people of this country say enough is enough? How many facts must the people of this country be presented with before they realize they are being lied to about immigration?

Did you know that the United States grants 2 million immigrant visas per year? Did you know, in addition to the immigrant visas we also issue 400,000 H1B work visas per year, 900,000 additional employment visas, 660,000 student visas, and 455,000 temporary employment transfers?

How many guest workers do we need in this country before our elected officials are satisfied that not enough Americans have lost their jobs to lower paid immigrants? Congressman Flake, on the Lou Dobbs show, made the comment that 5 percent of our workforce is made up of illegal aliens, and that we can't just deport 5 percent of the workers in this country.

Isn't it a coincidence that according to the U.S. Department of Labor, in California, a state with a large percentage of illegal aliens, the unemployment rate is 5.2 percent. http://data.bls.gov/cgi-bin/surveymost

So, what exactly does the STRIVE Act do for immigrants? First off it is an amnesty, no matter what they tell you. If it walks like a duck and quacks like a duck....

The STRIVE Act grants an almost guaranteed path to citizenship to most of the illegal aliens already here. First they become non-immigrants, whatever the hell that is supposed to mean, then if they can prove they have worked here for six years they, and their spouses and children, can become lawful residents. (Section 601) So instead of getting just the illegal aliens, we get the whole family, what a bargain!

It also makes them sit through English classes, just to show it is not in all actuality an amnesty. Yet the same was true in 1986 with IRCA, and everyone agreed that was an amnesty. (Section 601 & 602)

It also has a touch back clause in which they must return to Mexico for 24 hours before re-entering at an authorized port of entry. Current immigration law states that they must wait 10 years before attempting to re-enter the U.S. (Section 602)

Illegal aliens do not have to pay back taxes, they only have to enter into an agreement with the IRS to eventually pay the taxes. (Section 602)

The bill also requires taxpayers, you and I, to fund grants to private organizations to help illegal aliens apply for amnesty. (Section 662)

If an illegal alien applies for this amnesty and is denied for using fraudulent documents, the U.S. government cannot use that information to have that alien removed. Any government employee who divulges that information will be fined $10,000. (Section 604)

If you are currently in the U.S. on a legal visa, for whatever purpose, you do not qualify for this amnesty. However if you are in this country on an overstayed visa you do qualify. (Section 601)

The bill does not send illegal immigrants to the "back of the line". There are over 3 million aliens who have been approved for green cards as relatives of U.S. citizens or permanent residents and who have been waiting patiently for visas to become available. They will continue to have to wait overseas for years, even decades, for their visas to become available. Under the Flake-Gutierrez bill, millions of illegal immigrants who will claim to have been here illegally since 2006 can work in the U.S. and be eligible for permanent residence eight years after enactment (Section 602)

Employers who hired illegal aliens are absolved from all civil and criminal liability for having hired illegal aliens prior to this bill. (Section 607)

Illegal immigrants have other options to apply for amnesty under the Flake-Gutierrez bill - including the DREAM Act (title VI, subtitle B) and the AgJobs Act. (title VI, subtitle C)
Legal immigration would also be increased with the passage of this bill. A conservative estimate puts the numbers at an additional 700,00 green cards issued per year. Remember, we already grant 2 million of them a year, so now we will be giving out close to 3 million green cards a year. (Section 511)

The H1B visas would go up to a maximum of 180,000 per year. Students with graduate degrees in math or science are exempt from those numbers, which will, in all actuality increase those numbers. (Section 507)

Section 517 gives organizations the right send however many women to the U.S. who have a “credible fear of harm related to her sex“, and we will have no choice but to accept them.
In this bill, the workers' employers can apply for green cards for them at any time, and the workers can apply on their own after having worked in the program for five years. Once the green card applications are filed, the workers can stay and work as long as it takes for a green card to become available. Thus, there could be many millions of these foreign workers and their families in the country at any one time in the future. (sections 401, 407)

Now this one ought to get your attention. Employers are specifically allowed to lay-off American workers and replace them with "new" foreign workers as long as they lay-off the Americans more than 90 days before or after they file the petitions for the foreign workers. (section 402)

You might also have heard rumors of the plan for a North American Union. Well the Flake Gutierrez bill mandates that the Department of Homeland Security identifies progress of developing and implementing an “immigration security strategy for North America that works toward the development of a common security perimeter” for the U.S., Canada, and Mexico. (Section 113)

As for strengthening our border and enforcing immigration law, the bill requires that when additional vehicle barriers are built along the border, we have to consult with Mexican officials to solicit the views of Mexican communities, lessen tensions, and foster greater understanding! (sections 103, 123)

The taxpayer must provide immigration-law violators who are being detained with "individual and group counseling", "daily access to indoor and outdoor recreational programs and activities", services that recognize their "special religious, cultural [and] spiritual" needs, and must fund new detention facilities with "meaningful . . . recreational activities", "private toilet and shower facilities" and clothes that are not "prison-style uniforms or jumpsuits". (section 175, 178)

Currently, state and local law enforcement are able to voluntarily assist DHS with the enforcement of all our immigration laws - criminal and civil. The Flake-Gutierrez bill only allows them to assist in the enforcement of criminal immigration laws. This severely limits the ability of local law enforcement to detain illegal immigrants until they can be picked up by DHS. (Section 215)

The bill claims to have tough criminal penalties to crack down on gang violence. However, the bill does not take the single most effective step to combat immigrant gang violence - it does not make make members of criminal street gangs deportable (as the House-passed Sensenbrenner-King bill did last Congress). (section 234)

The Flake-Gutierrez bill prohibits state and local governments from punishing employer who hire illegal immigrants, from requiring employers to use the employment eligibility verification system, or from requiring that the system be used to verify the legal status of renters, public benefits applicants and people undergoing background checks. (section 301)

Employers nationwide cannot favor U.S. citizens for jobs over certain foreign workers, including illegal immigrants granted Temporary Protected Status. (section 304)

Employers can avoid using the verification system simply by calling new hires "independent contractors". (section 301)

Those are some of the provisions of the Flake Gutierrez bill. Does it sound like things are going to get any better if this bill makes it to President Bush for his signature, which he will gladly sign.

Finally a few thoughts on what this means to you if this bill does pass into law. Illegal immigrants are not eligible for most kinds of welfare. Once they are granted amnesty and then become citizens, they become eligible for billions of dollars in public assistance. The Heritage Foundation estimates the eventual fiscal cost to the taxpayers of amnesty will be $30 billion per year.

Amnesty recipients will receive Social Security benefits based on their illegal work. Since most illegal immigrants worked under fake Social Security Numbers or Numbers stolen from U.S. citizens, it will create unknown costs for the Social Security Administration. (Section 211 of the Social Security Protection Act, Pub L. No. 108-203)

In conclusion, when we passed IRCA back in 1986, we granted 2.7 million amnesties. This time it is 12-20 million amnesties. Since this bill does little to stop the flow of illegal aliens into our country, think about the next amnesty bill. Is it going to be for 30, 40, or even 50 million more illegal aliens? It doesn’t matter though, by then the American people will have forgotten the 20 million we granted amnesty to in 2007 just like they forgot about the 2.7 million we already granted amnesty to in 1986. My only suggestion for those of you who can’t seem to remember things like this, is that you learn to speak Spanish, because it will soon be our national language.

More illegal aliens data

I fear that the American public is woefully uninformed as to how serious the illegal alien problem is in this country. I wonder if they truly realize the dire consequences of allowing an unending stream of illegal aliens to flood across our borders. They are not getting the truth from the news media, nor are they getting it from their elected officials.

Since they are not getting the truth, a good portion of them have gotten apathetic and are unwilling to expend any time and energy to fight for the future of their country. Could this blanket of apathy be so pervasive that our country is doomed? I would hope not, but the signals are not good.

In 2006 it appeared that national attention had finally begun to focus on the issue of illegal aliens and the effects they are having upon this country. Then on May 1 thousands of illegal aliens, and their supporters, took to the streets in New York, Washington, Las Vegas, Miami, Chicago, Los Angeles, San Francisco, Atlanta, Denver, Phoenix, New Orleans, and Milwaukee.
These illegal aliens were demanding rights that are reserved for American citizens, not criminals who have violated numerous laws, including immigration law, labor law and identity theft laws. They deserve no rights.

Shortly afterwards, on May 15, 2006 President Bush went on national television and made a speech concerning immigration reform. Some of what the President said is as follows, with my comments to his statements. The President said,

“We're a nation of laws, and we must enforce our laws.”

The President is absolutely right, we are a nation of laws. Unfortunately our immigration laws have not been enforced. Our President, our Congress, our State and local officials all have not enforced the laws we already have regarding immigration and the hiring of illegal aliens. For that alone they are not worthy to hold our public trust nor the office for which they have been elected to.

These are some of the immigration laws we already have. They are taken from the United States Code, Title 8. The United States Code (U.S.C.) is a compilation and codification of the general and permanent federal law of the United States. If these immigration laws had been enforced we wouldn’t find ourselves with 20 million illegal aliens in this country, nor would we be having this discussion.

8 USC Sec. 1325 (REGARDING ILLEGAL ENTRY)
Any alien who -

1. enters or attempts to enter the United States at any time or place other than as designated by immigration officers, or

2. eludes examination or inspection by immigration officers, or

3. attempts to enter or obtains entry to the United States by a willfully false or misleading representation or the willful concealment of a material fact, shall, for the first commission of any such offense, be fined under Title 18 or imprisoned not more than six months, or both, and, for a subsequent commission of any such offense, be fined under Title 18, or imprisoned not more than two years or both.

(b) Improper time or place, civil penalties - Any alien who is apprehended while entering (or attempting to enter) the United States at a time or place other than as designated by immigration officers shall be subject to a civil penalty of -
(1) at least $50 and not more than $250 for each such entry (or attempted entry); or

(2) twice the amount specified in paragraph (1) in the case of an alien who has been previously subject to a civil penalty under this subsection. Civil penalties under this subsection are in addition to, and not in lieu of, any criminal or other civil penalties that may be imposed.

(c) Marriage fraud - Any individual who knowingly enters into a marriage for the purpose of evading any provision of the immigration laws shall be imprisoned for not more than 5 years, or fined not more than $250,000 or both.

(d) Immigration-related entrepreneurship fraud - Any individual who knowingly establishes a commercial enterprise for the purpose of evading any provision of the immigration laws shall be imprisoned for not more than 5 years, fined in accordance with title 18, or both.

Section 1324a (Hiring an illegal) states:
"Any person who knowingly hires/harbors/transports any illegal alien is guilty of a felony punishable by 10 years jail + $2000 fine per illegal alien + forfeiture of the vehicle or property used to commit the crime".

Section 1324c states, "All officers whose duty it is to enforce criminal laws shall have authority to make arrests for a violation of any provision of this section" (affirmed US v Perez-Gonzalez 2002 Fed App 0360, 6th Circ.).

Section 1644, same title states, "No local ordinance, rule, or measure shall stop law enforcement officers from enforcement of this section" (affirmed Southern District Court of NY, US v Rudy Guiliani,1996).

The President also said, “First, the United States must secure its borders.”

The President says we need to secure our border. T.J. Bonner, president of the National Border Patrol Council, made it perfectly clear why we need to secure our border when he made the following comment in December of 2004.

"Today, as we sit here, and every other day, 10,000--that's thousand--10,000 illegal aliens will cross our border. The United States Border Patrol will catch about 3,000 of those people..."
That means that about 7000 people make it into this country illegally, 2.5 million per year. I would say that is an invasion and it demands immediate attention.


The President then went on to say,

“Since I became President, we've increased funding for border security by 66 percent, and expanded the Border Patrol from about 9,000 to 12,000 agents. The men and women of our Border Patrol are doing a fine job in difficult circumstances, and over the past five years, they have apprehended and sent home about six million people entering America illegally.”

The President says he expanded the Border Patrol. If the President truly supported our Border Patrol Agents why did he allow one of his appointed U.S. Attorneys, Johnny Sutton to prosecute Ignacio Ramos and Jose Compean for shooting a drug smuggling illegal alien in the buttocks? Why has he refused to exonerate them when evidence has surfaced showing that they were wrongfully convicted? Why has the Justice Department allowed this U.S. Attorney to remain in office?

Another example, with a better outcome, just shows you that the trial of Agents Ramos and Compean was not an isolated incident.

Jose Guevara, an illegal alien got a "get out of jail free card" plus U.S. legal documents and monetary compensation from federal prosecutors in exchange for his testimony against a U.S. Border Patrol agent accused of using excessive force during an arrest.

Former agent David Sipe, who was convicted and fired, recently won an acquittal at a court-ordered retrial.

A federal appeals court in Texas ordered the new trial, saying prosecutors gave the illegal alien and two others additional inducements not disclosed at the time for their testimony, including Social Security cards, witness fees, permits allowing travel to and from Mexico, living expenses and free use of government phones.

If that is how our President and our Justice Department support our Border Patrol Agents, they don't need their support. The effect of this lack of support has also trickled down to the local law enforcement agencies. The same U.S. Attorney, Johnny Sutton, also prosecuted Sheriff Deputy Guillermo Hernandez when bullet fragments cut the lip and knocked out two teeth of an illegal alien passenger in a van that had tried to run the deputy over during a traffic stop.

When we see our law enforcement officials persecuted for doing their jobs, It is questionable whether the President is serious when he says he supports our Border Patrol Agents in their efforts to control illegal entry into this country.

Furthermore the President said,

“The United States is not going to militarize the southern border. Mexico is our neighbor, and our friend.“

Is that so. North Korea and South Korea are neighbors yet we have 41,000 military members guarding their border? Why can't we use the military to guard our own border? Also, would a friendly neighboring country assist its people in violating the laws of a neighboring country?

The Mexican government is giving out a colorful new comic book with advice for migrants…The 32-page book, The Guide for the Mexican Migrant, was published in December by Mexico's Foreign Ministry. Using simple language, the book offers safety information for border crossers, a primer on their legal rights and advice on living unobtrusively in the United States. Some friend!

The President continued by saying,

“Second, to secure our border, we must create a temporary worker program.”

Read that carefully. How is a guest worker program going to secure our border? We do not need a guest worker program. We have plenty of American workers who are willing to work if companies were willing to pay them a decent living wage.

In regards to his guest worker program the President said,

“Therefore, I support a temporary worker program that would create a legal path for foreign workers to enter our country in an orderly way, for a limited period of time. This program would match willing foreign workers with willing American employers for jobs Americans are not doing.”

Edwin Rubenstein wrote an article entitled "Looking (in vain) For Jobs 'Americans Won't Do'". In it he shows us the percentage of illegals doing a variety of jobs.

Ah, but there is no mention of the agricultural immigrant laborers. Did you know that less than 2% of all the illegal aliens in the United States are picking crops, but 41% are on welfare?
Next the President said,

“Third, we need to hold employers to account for the workers they hire.”

The law is already there to do this. I refer you once again to,
8 USC Section 1324a (Hiring an illegal)

"Any person who knowingly hires/harbors/transports any illegal alien is guilty of a felony punishable by 10 years jail + $2000 fine per illegal alien + forfeiture of the vehicle or property used to commit the crime".

Why hasn’t that law been enforced for all these years? Don't you think the loss of your business, a 10 year prison sentence and a fine of $2500 per illegal worker would cause employers to think twice before hiring an illegal alien worker?

This law does work when it is enforced. In an article by Donald Collins, entitled “Positive Reform Works!”, we read;

The Page One January 17, 2007 Wall Street Journal story entitled "Reversal of Fortune--An immigration raid aids blacks for a time" charts a transition which to immigration reform-minded Americans makes infinite good sense.

It tells about the aftermath of "raids by federal immigration agents on Labor Day weekend, a local chicken-processing company called Crider Inc. lost 75% of its mostly Hispanic 900-member work force. The crackdown threatened to cripple the economic anchor of this fading rural town" of Stillmore, Georgia. Since the 1990s, this company had enjoyed the use of a predominantly illegal work force, doubtless with great profitability. Now, however, "for local African-Americans, the dramatic appearance of federal agents presented an unexpected opportunity. Crider suddenly raised pay at the plant. An advertisement in the weekly Forest-Blade newspaper blared "Increased Wages" at Crider, starting at $7 to $9 an hour—more than a dollar above what the company had paid many immigrant workers. The company began offering free transportation from nearby towns and free rooms in a company-owned dormitory near to the plant. For the first time in years, local officials say, Crider aggressively sought workers from the area's state-funded employment office—a key avenue for low-skilled workers to find jobs.

That was not an isolated incident. On February 9, 2007, Sylvia Moreno, a Washington Post Staff Writer wrote the following;

CACTUS, Tex. -- The streets of this small, isolated city in the Texas Panhandle are virtually empty nowadays, and "For Rent" signs decorate dilapidated trailers and shabby 1940s-era military barracks that just weeks ago were full of tenants.

Sales of tortillas and other staples are down. Money wire transactions to Central America have mostly dried up. The "Guatemalas," as local residents call them, are almost all gone, and so are a significant number of Mexican nationals. An estimated 12 to 18 children are now living with only one parent since the other was arrested in a massive immigration raid at the biggest employer in town.

On Dec. 12, hundreds of Immigration and Customs Enforcement agents clad in riot gear and armed with assault rifles descended on the Swift & Co. meatpacking plant in a coordinated raid of six of the company's facilities nationwide. The operation was the government's largest single work-site enforcement operation ever. The plant in little Cactus -- a town better known in the state of Chihuahua, Mexico, and in the department of Quiché, Guatemala, where workers came from, than in Texas -- was the largest one raided. Almost a quarter of the 1,282 suspected illegal immigrants arrested in the raids were removed from the Cactus plant.

So they myth that illegal aliens are doing the work Americans won’t is a lie we are being told to force us to accept the fact that illegal aliens are here to stay because we need them to keep our economy running.

As for what to do with those illegal aliens already here, the President had this to say,
“It is neither wise, nor realistic to round up millions of people, many with deep roots in the United States, and send them across the border. There is a rational middle ground between granting an automatic path to citizenship for every illegal immigrant, and a program of mass deportation. That middle ground recognizes there are differences between an illegal immigrant who crossed the border recently, and someone who has worked here for many years, and has a home, a family, and an otherwise clean record.”

First I would like to comment on what the President means when he says these illegal aliens have a 'clean record'. First off they are in violation of 8 USC Sec. 1325, illegal entry into the United States. The penalty for that is:

(1) at least $50 and not more than $250 for each such entry (or attempted entry); or

(2) twice the amount specified in paragraph (1) in the case of an alien who has been previously subject to a civil penalty under this subsection. Civil penalties under this subsection are in addition to, and not in lieu of, any criminal or other civil penalties that may be imposed.

Secondly, in July of 2004 President Bush signed into law the Identity Theft Enhancement Law. The President himself said, in regards to this new law,

"This new law establishes in the federal criminal court the offense of aggravated identity theft. And someone convicted of that crime can expect to go to jail for stealing a person's good name. These punishments will come on top of any punishment for crimes that proceed from identity theft."

This new law imposed a mandatory 2 year prison sentence on top of any other offenses committed.

So we have illegal aliens using false or stolen documents to work in this country. That alone is worth a two year jail sentence and a $250 fine for illegal entry. Some way to get a 'clean' start at being an American!

As to rounding up and deporting every illegal alien in this country, that isn't necessary. We can get them to leave through attrition if we only take away the incentives for them to remain. If we stop hiring them, giving them tax funded social services, stop allowing them to have babies in our hospitals, and stop educating their children, they would leave on their own. Those that didn't could be dealt with in the manner that former President Eisenhower dealt with them.
President Eisenhower once quoted the following report in the New York Times, "The rise in illegal border-crossing by Mexican 'wetbacks' to a current rate of more than 1,000,000 cases a year has been accompanied by a curious relaxation in ethical standards extending all the way from the farmer-exploiters of this contraband labor to the highest levels of the Federal Government."

Thus began Operation Wetback. That term might not be politically correct today, but that is what it was called and this is what happened.

The operation began in California and Arizona and coordinated 1,075 Border Patrol agents along with state and local police agencies to mount an aggressive crackdown, going as far as police sweeps of Mexican-American neighborhoods and random stops and ID checks of "Mexican-looking" people in a region with many Native Americans and native Hispanics. Some 750 agents targeted agricultural areas with a goal of 1,000 apprehensions a day. By the end of July, over 50,000 aliens were caught in the two states. 488,000 people fled the country for fear of being apprehended. By September, 80,000 had been taken into custody in Texas, INS estimates that 500,000 to 700,000 illegals had left Texas voluntarily.

Operation Wetback deported approximately 80,000 Mexican nationals in the space of almost a year, although local INS officials claimed that an additional 500,000 to 700,000 had fled to Mexico before the campaign began. The INS estimates rested on the claim that most aliens, fearing apprehension by the government, had voluntarily repatriated themselves before and during the operation.

Back when this operation took place we had nowhere near the number of illegal aliens as we do now. Still between 500-700 thousand fled the country on their own. If we could do that now and have a wall in place to keep them from coming back our problems would be over.
Finally the President said,

“Fifth, we must honor the great American tradition of the melting pot, which has made us one nation out of many peoples. The success of our country depends upon helping newcomers assimilate into our society, and embrace our common identity as Americans. Americans are bound together by our shared ideals, an appreciation of our history, respect for the flag we fly, and an ability to speak and write the English language.”

Former Senator S. I. Hayakawa repeatedly said, “A common language is the glue that holds a people, and a nation together”. That glue no longer exists. We have schools teaching our children in a half dozen languages. Our government forms are printed in a half dozen languages for those who cannot speak English. In some places in Los Angeles you cannot get a job at McDonalds unless you speak Spanish! In the United States of America you are required to speak Spanish to get a job? Where is the assimilation when an American has to learn the language of a visitor, legal or illegal, to his country? We are no longer, '...one nation out of many peoples." We are becoming a divided country along racial and cultural lines. A country like that cannot survive long.

Those were the thoughts of President Bush regarding the current state of affairs regarding illegal aliens.

Former President Reagan also realized we a problem with illegal aliens. In 1986 President Reagan and Congress enacted the Immigration and Reform Control Act, otherwise known as the Simpson-Mazzoli Act. The goal of this legislation was to reduce the flow of illegal aliens into this country. It was to impose financial and other penalties for employers who hired illegal aliens, under the hope that if the jobs dried up the illegal aliens would stop coming. The law also granted a one time amnesty for 2.7 million illegal aliens who had been living inside the U.S. since 1982.

Since then Congress has passed seven other amnesties for illegal aliens, rewarding millions more with a 'path to citizenship'. If they needed seven other amnesty plans it is apparent that IRCA didn’t work,. Now we have President Bush and the U.S. Senate talking about amnesty again.

How many amnesties are we going to have to suffer through before the people of this country realize that our elected officials do not intend to do anything to stop the flow of illegal aliens into this country? They let them come in until the numbers get high enough that we demand action. Then they grant them amnesty and allow more new illegal aliens to come in. All the while we continue to vote for the same worn out party hacks who are so indebted to corporations and special interest groups that the will of the people means nothing to them.

It is not just at the national level that this is going on. Los Angeles Police Department, under a directive by the Los Angeles City Council, issued Special Order 40. Special Order 40 forbids the LAPD from arresting someone based upon their immigration status and forbids them from cooperating with the INS.

Los Angeles Mayor Antonio Villagarosa is quoted as saying, “It's not enough to elect Latino leadership if they're supporting legislation that denies the undocumented, they don't belong in office friends. They don't belong here.”

1989, New York Mayor Ed Koch made New York a 'sanctuary city' when he issued Executive Order 124. This prohibits city workers from informing INS about illegal aliens.
Since Ed Koch left office, David Dinkins, Rudy Giuliani, and Michael Bloomberg have kept EO 124 in force.

Remember 8 USC Section 1644? It stated "No local ordinance, rule, or measure shall stop law enforcement officers from enforcement of this section" So those city officials who make their cities sanctuaries for illegal aliens are in violation of federal law! Why have we allowed them to remain in office?

Remember, Rudy Giuliani is now considering a run for President in 2008. Do you honestly think he will do anything to stop the invasion?

Fabian Nunez is Speaker of the California State Assembly. He once said,

“And those rednecks that are out there making decisions for the betterment of their communities will think twice before they push forward anti immigrant legislation against our community. You can be as revolutionary as you want. You can be Chicano Nationalists, you can believe in the concept of Aztlan, you can believe in the concept of multiculturalism. We don't have to give our lives, we're not at that point. But we can give a little.”

If that isn’t enough, Art Torres, Chairman of the California Democratic Party made the following comment,

“The last gasp of white America. Understand that. And people say to me when I was on the Senate floor, when I was in the Senate, why do you fight so hard for affirmative action programs? And I tell my white colleagues because you're gonna need them.”

Those are all Americans, people in positions of authority that we have placed our trust in to do what is right for this country. Do you still feel like we have any chance of winning this war against illegal aliens? Now I would like to introduce you to the enemy.

Charles Truxillo, a University of New Mexico Chicano Studies professor predicts that the "Republica del Norte" is an inevitability. He envisions it encompassing all of California, Arizona, New Mexico, Texas, and southern Colorado, plus the northern Mexican states of Baja California, Sonora, Chihuahua, Coahuila, Nuevo León and Tamaulipas.

Truxillo went on to say the new country should be brought into being “by any means necessary,” but recently said it was unlikely to be formed by civil war. Instead, its creation will be accomplished by the electoral pressure of the future majority Hispanic population in the region.

Jose Angel Gutierrez, a Professor at University of Texas Arlington made the following statements,

“We remain a hunted people. Now you think you have a destiny to fulfill in this land that historically has been ours for 40,000 years. We are a new Mestiso nation, this is our homeland. We cannot, we will not, and we must not be made illegal in our own homeland. We are not immigrants that came from another country to another country. We are migrants free to travel the length and breadth of the Americas because we belong here. We are millions, we just have to survive. We have an aging white America. They are not making babies. They're dying. It's a matter of time. The explosion is in our population.”

“We have an aging white America. They are dying. They are shitting in their pants with fear! I love it! We have got to eliminate the gringo, and what I mean by that is if the worst comes to the worst, we have got to kill him!"

At a rally in L.A. on July 4, 2000, Augustin Cebeda, of the Brown Berets said,

"Go back to Boston! Go back to Plymouth Rock, Pilgrims! Get out! We are the future. You are old and tired. Go on. We have beaten you. Leave like beaten rats. You old white people. It is your duty to die ... Through love of having children, we are going to take over."

Mario Obledo, co-founder of the Mexican-American Legal Defense and Education Fund, or MALDEF, said that, “California is going to be a Hispanic state and anyone who doesn't like it should leave."

Richard Alatorre, a former Los Angeles city councilman stated at 1996 Latino summit conference,

"Because our numbers are growing ... [some are] afraid that we're going to take over the governmental institutions and other institutions. They are right, we will take them over, and we are not going to go away – we are here to stay, and we are saying 'ya basta' (enough!)."

Those are the voices of just a few of our enemies. There are many groups in favor of open borders and rights for illegal aliens. Among those are; The Mexican-American Legal Defense and Education Fund (MALDEF), the National Council of La Raza (NCLR), Movimiento Estudiantil Chicano de Aztlan (MEChA), and the National Immigration Forum (NIF).

These groups may not reflect the will of naturalized Hispanics, however a Zogby poll of Mexicans found that 58% of Mexican citizens believe that southwestern America is rightfully the territory of Mexico, and that citizens of Mexico do not need permission from the U.S. to enter. Only 28% disagreed with that premise.

Now that we know what our government is doing to protect us from this invasion, and who the invaders are and their attitudes, let’s see what this war is costing us. You may think illegal aliens aren’t affecting you. How wrong you would be!

In May of 2002 Diane West reported for World Net Daily that,

“In 1960 non Hispanic whites made up 82 percent of the population of Los Angeles County. Forty years later...the white population had dwindled to 31 percent while Hispanics...accounted for 44.6 of the population. This colossal surge has made the Mexican population of Los Angeles second only to that of Mexico City.”

Steve Camarota, for the Center for Immigration Studies wrote,
-Of our adult immigrants, 31 percent never finished high school, three and a half times the rate of native born Americans.
-The poverty rate for immigrants is 57 percent higher than for native born Americans
-Among immigrants, 24 percent use Medicaid, 29 percent use some form of welfare, 30 percent are eligible for the Earned Income Tax Credit
-A third of all immigrants lack health insurance
-Immigrant children account for 19 percent of all children in public schools and about 21 percent of those about to enter school.

In the Washington Post, Robert Samuelson wrote an article entitled, “We Don’t Need Guest Workers”. In a portion of his article he states,

"Since 1980 the number of Hispanics with incomes below the poverty level (about $19,300 in 2004 for a family of four) has risen 162 percent. Over the same period, the number of non-Hispanics whites in poverty rose 3 percent and the number of blacks 9.5 percent. What we have now--and would with guest-workers--is a conscious policy of creating poverty in the United States while relieving it in Mexico."

More than 380,000 anchor babies born in the United States in 2005 were to parents who are illegal aliens; making those 380,000 babies automatically U.S. citizens.
97.2% of all costs incurred from those births were paid by the American taxpayer.

More than 66% of all births in California are to illegal alien Mexicans on Medi-Cal, whose births were paid for by taxpayers.

Those children grow up entitled to all the benefits of citizenship including free education at your expense.

In 1982, the U.S. Supreme Court ruled that it would be unconstitutional for any state or school district to deny K-12 education to a child residing in that state or school district on the basis of the child's being an illegal alien. Plyler v. Doe 457 U.S. 202 (1982)

The lifetime fiscal impact (taxes paid minus services used) for the average adult Mexican illegal alien on the average American taxpayer is $55,000 over a five-year span. You personally are giving $11,000 every year to illegal aliens.

Those are just the ‘honest hard working immigrants looking for a better life’. What about the criminals that flow across the borders as well?

95% of warrants for murder in Los Angeles are for illegal aliens.
83% of warrants for murder in Phoenix are for illegal aliens.
86% of warrants for murder in Albuquerque are for illegal aliens.


24.9% of all inmates in California detention centers are Mexican nationals here illegally.
40.1% of all inmates in Arizona detention centers are Mexican nationals here illegally.
48.2% of all inmates in New Mexico detention centers are Mexican nationals here illegally.

$1.6 billion is spent annually in prison costs to house, feed and clothe illegal aliens who fill 32% of our federal and state prisons (Fox News Channel O Reilly Factor)

Now you tell me again that illegal aliens aren’t costing you. Tell me that they aren’t affecting your life, at least by keeping your taxes high to pay for the programs they receive.

If you are not mad yet, you should be. Your continued silence on this issue implies your consent. If you don’t take action soon your country will be gone. As more and more illegal aliens enter our country, they give birth to more and more anchor babies. These children grow up and become politically active, obtain positions of power such as Mayor Villagarosa of Los Angeles, or Fabian Nunez of the State Assembly. Soon their political clout will be more than we can deal with and we will have lost our nation because you sat back and let it happen.

You must contact your elected officials relentlessly, at all levels of government, and let them know you will not tolerate any guest worker/amnesty program. You must demand that our border be sealed and our Border Patrol allowed to do their job without fear of criminal prosecution by renegade U.S. Attorneys.

A bit about the Federal Reserve Bank

I have made mention that the Federal Reserve Bank is unconstitutional. Many times I have been told that I am wrong, that I don't know what I am talking about. I would like to lay out my reasons for believing this.

Article I, Section 8 of the Constitution gives the power to coin money to the Congress. On December 23, 1913, the U.S. Congress gave that power over to a central bank, owned by a consortium of privately owned banks. This bank was named the Federal Reserve Bank, a name that is misleading because, although the Chairman is selected by the President, it is not run by the U.S. Government. Essentially, the Act divided the United States into 12 different regions, assigning each region its own federal bank.

The Congress did this during Christmas recess and the Senate, with only 3 members present, approved it with a unanimous voice vote. There was not a quorum present, and therefore was not legally passed into law.

The Ninth Circuit Court of Appeals ruled that the FED is not, in fact, a federal institution.

Plaintiff, who was injured by vehicle owned and operated by a federal reserve bank, brought action alleging jurisdiction under the Federal Tort Claims Act.
The United States District Court for the Central District of California, David W. Williams, J., dismissed holding that federal reserve bank was not a federal agency
within meaning of Act and that the court therefore lacked subject-matter jurisdiction. Appeal was taken. The Court of Appeals, Poole, Circuit Judge, held that federal reserve banks are not federal instrumentalities for purposes of the Act, but are independent, privately owned and locally controlled corporations.

Representative Louis T. McFadden said, in regards to the FED, "We have in this country one of the most corrupt institutions the world has ever known. I refer to the Federal Reserve Board...This evil institution has impovershed...the people of the United States...and has practically bankrupted our government. It has done this through...the corrupt practices of the moneyed vultures who control it."

To understand how the FED has ruined this country, you have to understand the concept of fractional reserve banking. Fractional reserve banking is a system in which only a fraction of the total deposits managed by a bank must be kept in reserve. In the U.S., this system is maintained by the Federal Reserve Board.

Since the United States no longer has its own currency, it has to borrow money from somewhere to operate. If you think your tax dollars goes toward the operation of the government, why do we have a national debt? The government is borrowing money from the FED to operate. Your taxes are going towards the paying of interest on that loan. Even so, the U.S. debt is so huge that we are borrowing additional money from the FED just to pay for the interest, which money, in turn, is charged additional interest.
The Federal Reserve Bank is therefore lending money to the United States Government, THAT IT DOES NOT HAVE TO BEGIN WITH! It is then charging interest on that money, which is paid for by your taxes.

Thomas Jefferson again lamented this cycle of borrowing when he stated, “I wish it were possible to obtain a single amendment to our Constitution--taking from the federal government their power of borrowing“

Take out a dollar bill from your wallet and see what it says on it. It says Federal Reserve Note. Nowhere does it say anything at all about being United States currency On the top of the old United States Notes, and at the bottom is used to say, WILL PAY TO THE BEARER ON DEMAND. In 1963 those words were removed from all newly issued Federal Reserve Notes, making them a worthless fiat currency. Try taking a dollar bill to any Federal Reserve Bank and redeeming it for gold or silver.

The fight for control over our money system has been going on since the time of the revolutionary war. Thomas Jefferson warned of the dangers of allowing banking systems to control our money, "If the American people ever allow private banks to control the issue of their money, first by inflation and then by deflation, the banks and corporations that will grow up around them (around the banks), will deprive the people of their property until their children will wake up homeless on the continent their fathers conquered."
Isn't that exactly what the FED does? You see it all the time if you pay attention to the stock market. When inflation rises, the Federal Reserve Chairman constantly raises and lowers interest to control our economy. Exactly what Jefferson warned us about.

Before the Revolutionary War the United States was prospering. On a trip to England, the Bank of England asked Benjamin Franklin to explain the reasons for the economic success of the colonies. Franklin replied, "That is simple. In the colonies we issue our own money. It is called Colonial Scrip. We issue it in proper proportion to demands of trade and industry to make the products pass easily from the producers to the consumers. In this manner, creating for ourselves our own paper money, we control its purchasing power, and we have no interest to pay no one."

Almost immediately, under pressure by the Bank of England, the English Parliament passed the Currency Act of 1764 which prohibited the colonies from making their own money. They were placed upon a gold standard. In his autobiography Franklin tells what happened next, "In one year, the conditions were so reversed that the era of prosperity ended, and a depression set in, to such and extent that the streets of the Colonies were filled with unemployed."

Why the interest in controlling the currency of the United States? If you think about money as a commodity you can understand that if someone has a monopoly on that commodity they can raise or lower the price of it to benefit them. Not only that, if someone controls the money of a country, they control that country.

Otto Von Bismarck, Chancellor of Germany, 1871, made the following statement, "The division of the United States into federations of equal force was decided long before the civil war by the high financial powers of Europe. These bankers were afraid that the United States, if they remained as one block, would obtain economic and financial independence which would upset their financial domination over the world."

Therefore the Central Banks realized they must stop the United States from controlling its own currency. Former President Andrew Jackson realized this and fought to take this power from the central banks.

“Controlling our currency, receiving our public moneys, and holding thousands of our citizens in dependence--would be formidable and dangerous than a military power of the enemy.” Andrew Jackson

At the time Jackson was elected President the United States the Federal Bank had control of our currency. Jackson vowed to route them out like a den of vipers. However, the head of the U.S. Bank, Nicholas Biddle made the following statements, showing just how serious they were in maintaining control of our money, "This worthy President thinks that because he has scalped Indians and imprisoned Judges, he is to have his way with the Bank. He is mistaken."

To show President Johnson what they would do to the people of the country, Biddle made the following statement,

"Nothing but widespread suffering will have any effect on Congress...Our only safety is in pursuing a steady course of firm restriction-and I have no doubt that such a course will ultimately lead to the restoration of the currency and the recharter of the bank. "

Even under threat from the Federal Bank, Jackson was successful in blocking the renewal of their charter. After doing so he became the only President to ever pay off the national debt, and the U.S thrived and prospered as it expanded westward.

After the Central Banks charter was allowed to expire they considered a way to regain control of U.S. currency. They reverted to the timeless scheme of war to create national debt. So the plans to start a civil war in the United States was hatched.

History teaches us that the Civil War was fought over slavery. According to the words of President Lincoln himself, he had no interest in stopping the practice of slavery.
"I have no purpose, directly or indirectly, to interfere with the institution of slavery in the states where it now exists. I believe I have no lawful right to do so, and I have no inclination to do so."

So, if the Civil War was not about slavery, what caused it? The Northern Industrialists had used protective tariffs to prevent the southern states from buying cheaper European goods. Europe retaliated by buying cotton from the south. The south was faced with paying higher prices for their goods and a loss of income from their cotton sales. So they seceded from the Union.

When President Abraham Lincoln was wondering how to finance the Civil War, he was told, “Why Lincoln, that is easy; just get Congress to pass a bill authorizing the printing of full legal tender treasury notes...and pay your soldiers with them and go ahead and win your war with them also.”

When Lincoln asked if the people would accept them he was again told, ‘The people or anyone else will not have any choice in the matter, if you make them full legal tender. They will have the full sanction of the government and be just as good as any money; as Congress is given that express right by the Constitution.”

It should be now apparent that our government has the right to print its own money. The idea of a centralized, privately owned Federal Bank is a violation of Constitutional principle.

I leave you now with the words of former New York Mayor, John Hylan, “The real menace to our Republic is the invisible government which like a giant octopus sprawls its slimy legs over our cities, states and nation. At the head is a small group of banking houses... This little coterie...run our government for their own selfish ends. It operates under cover of a self-created screen...seizes...our executive officers...legislative bodies...schools...courts...newspapers and every agency created for the public protection.”

That is why I believe the FED and their influence over our economy is unconstitutional.

Are you politically correct?

Just what is it about people that they worry about being politically correct? According to one definition political correctness is a term used to describe language that is intended to provide a minimum of offense. I can understand not being rude or vulgar, but I consider that being civil and polite. However when it comes to telling the truth about something, one should not have to worry about being politically incorrect, or hurting someone's feelings.

All through the ages there have been great men who were not afraid to stand up and speak the truth. Being politically correct never crossed their minds.

John the Baptist openly condemned the people who flocked to be baptized by him in Luke 3:7, "Then said he to the multitude that came forth to be baptized of him, O generation of vipers, who hat warned you to flee from the wrath to come?"

Later, Jesus Himself spoke plainly to the people in Mark 11:17, "And he taught, saying unto them, Is it not written, My house shall be called of all nations the house of prayer? but ye have made it a den of thieves."

These great men were unafraid to speak the truth, no matter who it offended. That is one sign of greatness, being confident enough in your views that you are not afraid to offend others by speaking the truth.

If you look back to the birth of our nation, you might remember the famous speech given by Patrick Henry to the Virginia House of Burgesses on March 23, 1775. The words "...give me liberty or give me death." are well known by almost all. However did you also know that, during the same speech, he said this?

"Should I keep back my opinions at such a time, through fear of giving offense, I should consider myself as guilty of treason towards my country, and of an act of disloyalty toward the Majesty of Heaven, which I revere above all earthly kings."

That sounds like a resounding proclamation concerning his willingness to speak the truth, no matter who he offends.

Therefore you can see that all through time, great men have spoken the truth and not been afraid of who they would offend by doing so.

I wonder, with today's atmosphere of political correctness, what would be the outrage of certain groups if we were to announce that our Immigration and Customs Enforcement were initiating an operation called Operation Wetback? The Hispanics, the ACLU, and who knows who else would be up in arms, demanding that we rename it. They would accuse ICE of profiling Mexicans.

You would be surprised to know that back in 1954, President Dwight D. Eisenhower did just that. He had the INS conduct Operation Wetback in which 80,000 illegal alien Mexicans were deported. INS also claimed that between 500,000-700,000 fled the country on their own in fear of being deported.

That could never happen today. Not only because our society would not tolerate the term 'Wetback', or the thought that INS was going door to door in predominantly Hispanic communities. It couldn’t happen because our government doesn’t have the courage to do what is right for this country!

The United States Border Patrol state that 10,000 illegal aliens enter this country every day. Of those, 3000 are apprehended. That means 7000 get through every day, 210,000 per month, 2.5 million every year.

Our government, the people you vote for, pander and cater to these criminals by providing them with benefits they are not entitled to and offer them amnesty in the guise of guest worker programs and pathways to citizenship.

Did you know that the United States allows more legal immigrants into this country every year than the rest of the world combined? We are generous enough with our immigration policy. Now we are expected to open our arms to 2.5 million illegal immigrants every year as well? I think not!

A resounding 80% of the American public want our borders closed. A good percentage of that number want all illegal aliens deported. So why isn’t our government listening?
Part of the reason can be placed firmly upon your shoulders. You continue to vote for the same political hacks who owe their allegiance to big business and special interest groups. Your opinions mean nothing to them.

If you think that only the Democrats are supporting illegal aliens, think again. George W. Bush, a Republican, has stated he will sign a guest worker/pathway to citizenship bill for the estimated 20 million illegal aliens in this country. John McCain, presidential hopeful, and also a Republican, is at the forefront in the Senate to push for that very legislation which would grant these illegal aliens citizenship. So you cannot say it is a Democratic problem.

The Republicans had control of Congress since George W. Bush took office and they did NOTHING, N-O-T-H-I-N-G, to stop this invasion. Yet you still vote for them because they are the lesser of two evils. They are the same and you would not be able to deny it if you would only open your eyes.

Finally, if you think that these immigrants only come here looking for work and a better life you are blind and deaf to the truth. These people want the land back that we took from them. They want the white man out and they are willing to do anything to achieve their goal. Don’t believe me, read the following.

These people, the illegal aliens, and their spokespeople have declared war on America. Unless we that through our heads we will never get the proper mindset to fight this invasion. If you truly care about your country, about your future and your children’s future, you had better wake up and start paying attention to what your elected officials are doing in regards to illegal aliens. They need to be held accountable to the people of this country, not a bunch of wetbacks. There I said it, I guess that means I am not politically correct. Think I care? Neither should you.

The Constitution, the people, and stupidity...

I am still undecided on what to think about the majority of Americans. I cannot decide if you are ignorant, apathetic, or just downright stupid. I see plenty of stupidity on a daily basis, but when it comes to our country, and its political system, I have not yet decided if the boat we find ourselves in is due to stupidity alone.

A long time ago, James Madison, our 4th President made the following comment. He said, "Do not separate text from historical background. If you do, you will have perverted and subverted the Constitution, which can only end in a distorted, bastardized form of illegitimate government."

Any discussion of government, or consideration of laws and legislation, should therefore take into consideration the historical background. Only then can you understand our Constitution and our form of government. To learn the history behind these documents you must look to the writings of those people who were involved in creating them, Jefferson, Madison, Hamilton, Washington, and many others.

That is where I find a problem with people today. Too many people say that our government only has our best interests in mind. Daniel Webster once said, "Good intentions will always be pleaded for every assumption of authority. It is hardly too strong to say that the Constitution was made to guard people against the dangers of good intentions."

I would hope that people have enough of an understanding of U.S. history to be familiar with the events leading up to the Declaration of Independence, the Revolutionary War, and the framing of the Constitution. If not, then trying to explain the following concepts will be an exercise in futility. I do not wish to sound condescending, but I feel the need to explain the following in terms that a 5 year old could understand. It is obvious that many people today have forgotten the principles I am about to outline.

The Declaration of Independence states, "That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed..."

That is a simple, yet profound statement. It lays out the reason for governments, and the authority under which it acts. Governments are created to secure our rights, and they get their powers from us, the people.

Next, the United States Constitution states, "We the people of the United States, in order to form a more perfect union, establish justice, insure domestic tranquility, provide for the common defense, promote the general welfare, and secure the blessings of liberty to ourselves and our posterity, do ordain and establish this Constitution for the United States of America."

Again, with the simple phrase, ‘We the people’, this Constitution outlined the duties and authorities given to this form of government our country was to create.

Finally, returning to the Declaration of Independence, "That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness."

The Declaration basically says that if a form of government is not doing its job, and is violating our life, liberty, and pursuit of happiness it is the right of the people to alter or abolish it. Basically that means that if we built it, we can fix it our tear it down and build another one that does what it is supposed to do.

To make it clearer, I would like to quote Abraham Lincoln, “Our safety, our liberty, depends upon preserving the Constitution of the United States as our fathers made it inviolate. The people of the United States are the rightful masters of both Congress and the courts, not to overthrow the Constitution, but to overthrow the men who pervert the Constitution.”

Returning to my main point, the American people have forgotten the role of government. The government works for us, not vice versa. If an overwhelming majority of the public disagrees with the actions of its leaders, then those leaders should heed the voices of the people. The people of this country gripe, complain, and moan about any number of actions their government takes, yet they refuse to do anything about it.

How many career politicians do you see in office? This country keeps getting worse because we continue to vote back into office the same worn out trash as our Senators and Congressmen.
That is why I say people are either ignorant, apathetic, or stupid. Otherwise things wouldn’t have gotten to the point they are today. Which of the three are you?
